5	4		SENATE CONCURRENT RESOLUTION
6	5		WHEREAS, The Texas Legislature for each of the last 16
7	6		regular sessions has adopted a concurrent resolution authorizing
8	7		the creation and appointment of joint interim legislative study
9	8		committees by the lieutenant governor and speaker of the house of
10	9		representatives; and
11	10		WHEREAS, Renewal of the prior authorizations to the presiding
12	11		officers enables the legislature to address and study issues that
13	12		remain unresolved on sine die adjournment or that emerge subsequent
14	13		to that time; and
15	14		WHEREAS, It is also desirable to adopt by resolution various
16	15		rules and policies regarding the operation of joint committees to
17	16		supplement, and reconcile differences between, the senate and house
18	17		rules of procedure; now, therefore, be it
19	18		RESOLVED, That the 84th Legislature of the State of Texas
20	19		hereby authorize the lieutenant governor and speaker of the house
21	20		of representatives to create by mutual agreement such joint
22	21		committees as they consider necessary during the term of this
23	22		legislature; and, be it further
24	23		RESOLVED, That each joint committee created pursuant to this
25	24		resolution be composed of such combination of legislators, state
26	25		officials, or citizen members as shall be determined mutually by
27	26		the presiding officers of each house; and, be it further
28	27		RESOLVED, That on the request of the presiding officers, the
29	28		governor may appoint members to a joint committee created pursuant
30	29		to this resolution; and, be it further
31	30		RESOLVED, That the presiding officers issue for each
32	31		committee so created a joint proclamation identifying the issue or
33	32		issues to be studied and listing the committee membership or
34	33		describing the committee composition and that the proclamation be
35	34		filed with the secretary of the senate and the chief clerk of the
36	35		house of representatives; and, be it further
37	36		RESOLVED, That the presiding officers designate jointly a
38	37		chair, or designate alternatively two co-chairs, from among the
39	38		committee membership; and, be it further
40	39		RESOLVED, That the chair or co-chairs, acting jointly and
41	40		within four weeks of the proclamation, prepare and present to the
42	41		presiding officers a proposal for budget and staffing; and, be it
43	42		further
44	43		RESOLVED, That the chair or co-chairs be directed to use to
45	44		the greatest extent possible the existing staff and administrative
46	45		resources of committee members, standing committees, officers of
47	46		the senate and house, and legislative service agencies; and, be it
48	47		further
49	48		RESOLVED, That the presiding officers jointly review each
50	49		budget and staffing proposal, adopt budgetary and staffing
51	50		allocations, and determine the manner in which each joint committee
52	51		is to be funded; and, be it further
53	52		RESOLVED, That the joint committee chair, or the co-chairs
54	53		acting by mutual agreement, have authority to create and appoint
55	54		subcommittees or affiliated advisory panels and to designate
56	55		respective chairs for each, contingent on the advance approval of
57	56		the presiding officers for the creation and appointment of
58	57		subcommittees or advisory panels containing membership external to
59	58		the committee; and, be it further
60	59		RESOLVED, That each joint committee, and its subcommittees
61	60		and advisory panels, convene at the call of its chair or co-chairs;
62	61		provided that no joint committee, nor its subcommittees or advisory
63	62		panels, shall convene in a public hearing or other meeting for the
64	63		transaction of business unless public notice has been posted by its
65	64		chair or co-chairs at the locations specified by the senate and
66	65		house rules of procedure for posting of notice of standing
67	66		committee meetings at least five calendar days in advance of the
68	67		hearing or meeting; and, be it further
69	68		RESOLVED, That the preceding clause be construed, for
70	69		purposes of Section 551.046, Government Code, as a joint rule of the
71	70		senate and house of representatives controlling the posting of
72	71		notice for joint committees, and their subcommittees and advisory
73	72		panels, in lieu of required posting with the secretary of state;
74	73		and, be it further
75	74		RESOLVED, That each joint committee have authority to issue
76	75		process as provided in Sections 301.024-301.027, Government Code,
77	76		provided that any motion for the issuance of process must receive
78	77		the record vote of at least two-thirds of those present and voting,
79	78		a quorum being present; and, be it further
80	79		RESOLVED, That each joint committee be entitled to accept
81	80		grants and donations as provided by Sections 301.032(b) and (c),
82	81		Government Code, and that, on expiration of a joint committee, any
83	82		unexpended funds remaining from a grant or donation be transferred
84	83		in equal proportions to the accounts of the senate and house of
85	84		representatives unless otherwise provided by the grantor or donor;
86	85		and, be it further
87	86		RESOLVED, That each joint committee, except as modified by or
88	87		pursuant to this resolution, have all other powers and duties
89	88		provided to special committees by Subchapter B, Chapter 301,
90	89		Government Code, and the senate and house rules of procedure; and,
91	90		be it further
92	91		RESOLVED, That the operating accounts for each joint
93	92		committee created pursuant to this resolution and any grants and
94	93		donations that such committee may receive be administered by the
95	94		accounting and purchasing sections of the Texas Legislative
96	95		Council; and, be it further
97	96		RESOLVED, That the Texas Legislative Council accounting and
98	97		purchasing sections prepare, under the guidance of the presiding
99	98		officers, a manual of procedures for joint committees and other
100	99		entities created by the legislature for which funds are to be
101	100		administered by the Texas Legislative Council establishing
102	101		requirements as to printing needs, accounting procedures, ultimate
103	102		disposition of records, and other administrative and financial
104	103		matters; and, be it further
105	104		RESOLVED, That citizen members appointed by the lieutenant
106	105		governor or speaker of the house of representatives to joint
107	106		committees created pursuant to this resolution be reimbursed from
108	107		funds appropriated to the Texas Legislative Council for expenses of
109	108		transportation, meals, lodging, and incidentals for travel on
110	109		official committee business, at rates established by the joint
111	110		chairs of the Texas Legislative Council consistent with provisions
112	111		of the General Appropriations Act; and, be it further
113	112		RESOLVED, That citizen members appointed by the governor to
114	113		joint committees created pursuant to this resolution be reimbursed
115	114		from funds appropriated to the office of the governor for expenses
116	115		of travel on official committee business, at rates established by
117	116		the joint chairs of the Texas Legislative Council consistent with
118	117		provisions of the General Appropriations Act; and, be it further
119	118		RESOLVED, That citizen members appointed by the lieutenant
120	119		governor to senate select committees and citizen members appointed
121	120		by the speaker of the house of representatives to house committees
122	121		expanded or created under House Rule 4, Sections 24, 57, and 58,
123	122		when engaged in travel on official committee business, be
124	123		reimbursed for (1) transportation expenses at the same rates as
125	124		authorized for state employees by the General Appropriations Act,
126	125		and (2) actual expenses for meals, lodging, and incidentals,
127	126		subject to any maximum reimbursement limitations for meals and
128	127		lodging set by the Senate Administration Committee for senate
129	128		select committees and by the Committee on House Administration for
130	129		house select committees; and, be it further
131	130		RESOLVED, That the Texas Legislative Council be authorized to
132	131		reimburse the senate and house of representatives for expenses
133	132		incurred by members of the senate and house for transportation,
134	133		meals, lodging, and incidentals for travel on official business of
135	134		joint committees created pursuant to this resolution; and, be it
136	135		further
137	136		RESOLVED, That the final report of each joint committee be
138	137		approved by a majority of the voting membership of the committee;
139	138		dissenting voting members may attach statements to the final report
140	139		subject to any limitations specified in the rules adopted by the
141	140		committee; and, be it further
142	141		RESOLVED, That each joint committee created pursuant to this
143	142		resolution expire on January 10, 2017, or an earlier date specified
144	143		in the proclamation creating the committee.
