| 7 | 6 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 7 | | SECTION 1. Section 52f, Article III, Texas Constitution, is |

| 9 | 8 | | amended to read as follows: |
|---|
| 10 | 9 | | Sec. 52f. A county with a population of 7,500 [5,000] or |
|---|
| 11 | 10 | | less, according to the most recent federal census, may construct |
|---|
| 12 | 11 | | and maintain private roads if it imposes a reasonable charge for the |
|---|
| 13 | 12 | | work. The Legislature by general law may limit this authority. |
|---|
| 14 | 13 | | Revenue received from private road work may be used only for the |
|---|
| 15 | 14 | | construction, including right-of-way acquisition, or maintenance |
|---|
| 16 | 15 | | of public roads. |
|---|
| 17 | 16 | | SECTION 2. This proposed constitutional amendment shall be |

| 18 | 17 | | submitted to the voters at an election to be held November 3, 2015. |

| 19 | 18 | | The ballot shall be printed to permit voting for or against the |

| 20 | 19 | | proposition: "The constitutional amendment to authorize counties |
