76 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
87 SECTION 1. Section 52f, Article III, Texas Constitution, is
98 amended to read as follows:
109 Sec. 52f. A county with a population of 7,500 [5,000] or
1110 less, according to the most recent federal census, may construct
1211 and maintain private roads if it imposes a reasonable charge for the
1312 work. The Legislature by general law may limit this authority.
1413 Revenue received from private road work may be used only for the
1514 construction, including right-of-way acquisition, or maintenance
1615 of public roads.
1716 SECTION 2. This proposed constitutional amendment shall be
1817 submitted to the voters at an election to be held November 3, 2015.
1918 The ballot shall be printed to permit voting for or against the
2019 proposition: "The constitutional amendment to authorize counties
2120 with a population of 7,500 or less to perform private road
2221 construction and maintenance."
