55 A JOINT RESOLUTION
66 proposing a constitutional amendment authorizing the legislature
77 to nullify an order, rule, policy, or similar measure adopted by the
88 executive branch of the federal government that exceeds the
99 authority granted by the United States Constitution.
1010 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Article III, Texas Constitution, is amended by
1212 adding Section 68 to read as follows:
1313 Sec. 68. The legislature without the approval of the
1414 governor may nullify an executive order, agency rule or policy, or
1515 similar measure adopted by an official or entity within the
1616 executive branch of the federal government, if the legislature by a
1717 vote of two-thirds of the membership of each house determines that
1818 the order, rule, policy, or measure exceeds the authority granted
1919 to the executive branch by the United States Constitution. An
2020 order, rule, policy, or measure nullified by the legislature has no
2121 legal effect in this state and may not be enforced or recognized as
2222 having legal effect by this state or a political subdivision of this
2323 state.
2424 SECTION 2. This proposed constitutional amendment shall be
2525 submitted to the voters at an election to be held November 3, 2015.
2626 The ballot shall be printed to permit voting for or against the
2727 proposition: "The constitutional amendment authorizing the
2828 legislature to nullify an order, rule, policy, or similar measure
2929 adopted by an official or entity within the executive branch of the
3030 federal government that exceeds the authority granted to that
3131 branch by the United States Constitution."
