| 10 | 10 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Article III, Texas Constitution, is amended by |
|---|
| 12 | 12 | | adding Section 68 to read as follows: |
|---|
| 13 | 13 | | Sec. 68. The legislature without the approval of the |
|---|
| 14 | 14 | | governor may nullify an executive order, agency rule or policy, or |
|---|
| 15 | 15 | | similar measure adopted by an official or entity within the |
|---|
| 16 | 16 | | executive branch of the federal government, if the legislature by a |
|---|
| 17 | 17 | | vote of two-thirds of the membership of each house determines that |
|---|
| 18 | 18 | | the order, rule, policy, or measure exceeds the authority granted |
|---|
| 19 | 19 | | to the executive branch by the United States Constitution. An |
|---|
| 20 | 20 | | order, rule, policy, or measure nullified by the legislature has no |
|---|
| 21 | 21 | | legal effect in this state and may not be enforced or recognized as |
|---|
| 22 | 22 | | having legal effect by this state or a political subdivision of this |
|---|
| 23 | 23 | | state. |
|---|
| 24 | 24 | | SECTION 2. This proposed constitutional amendment shall be |
|---|
| 25 | 25 | | submitted to the voters at an election to be held November 3, 2015. |
|---|
| 26 | 26 | | The ballot shall be printed to permit voting for or against the |
|---|
| 27 | 27 | | proposition: "The constitutional amendment authorizing the |
|---|
| 28 | 28 | | legislature to nullify an order, rule, policy, or similar measure |
|---|
| 29 | 29 | | adopted by an official or entity within the executive branch of the |
|---|
| 30 | 30 | | federal government that exceeds the authority granted to that |
|---|
| 31 | 31 | | branch by the United States Constitution." |
