| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter B, Chapter 54, Water Code, is amended |
|---|
| 10 | 10 | | by adding Section 54.026 to read as follows: |
|---|
| 11 | 11 | | Sec. 54.026. ELIGIBILITY TO VOTE IN CONFIRMATION ELECTION. |
|---|
| 12 | 12 | | To be eligible to vote in an election to confirm the creation of a |
|---|
| 13 | 13 | | district, a person must reside in the district for at least one |
|---|
| 14 | 14 | | year immediately preceding the date of the election. |
|---|
| 15 | 15 | | SECTION 2. Subchapter F, Chapter 54, Water Code, is amended |
|---|
| 16 | 16 | | by adding Section 54.506 to read as follows: |
|---|
| 17 | 17 | | Sec. 54.506. ELIGIBILITY TO VOTE IN CERTAIN BOND ELECTIONS. |
|---|
| 18 | 18 | | To be eligible to vote in an election authorizing a district's |
|---|
| 19 | 19 | | first issuance of bonds payable wholly or partly from ad valorem |
|---|
| 20 | 20 | | taxes, a person must reside in the district for at least one year |
|---|
| 21 | 21 | | immediately preceding the date of the election. |

| 23 | 23 | | 3. (a) Section 54.026, Water Code, as added by this |
|---|
| 24 | 24 | | Act, applies only to a confirmation election ordered on or after the |
|---|
| 25 | 25 | | effective date of this Act. |

| 26 | 26 | | (b) Section 54.506, Water Code, as added by this Act, |
|---|
| 27 | 27 | | applies only to a bond election ordered on or after the effective |
|---|
| 28 | 28 | | date of this Act. |
|---|
| 29 | 29 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 30 | 30 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 31 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 32 | 32 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 33 | 33 | | Act takes effect September 1, 2017. |
