55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to county law libraries.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 323.021, Local Government Code, is
1010 amended by amending Subsection (a) and adding Subsection (c) to
1111 read as follows:
1212 (a) The commissioners court of a county by order may
1313 establish and maintain a county law library at the county seat or
1414 another location determined by the commissioners court.
1515 (c) The commissioners court of a county may establish,
1616 maintain, and operate in cooperation with other counties a joint
1717 free county law library for the benefit of the cooperating counties
1818 in the same manner that a joint county library may be established
1919 and operated under Section 323.010.
2020 SECTION 2. Section 323.023(b), Local Government Code, is
2121 amended to read as follows:
2222 (b) The clerks of the respective courts shall collect the
2323 costs and pay them to the county treasurer, or to any other official
2424 who discharges the duties commonly delegated to the county
2525 treasurer, for deposit in a fund to be known as the county law
2626 library fund. The fund may be used only for:
2727 (1) establishing the law library after the entry of
2828 the order creating it;
2929 (2) purchasing or leasing library materials,
3030 maintaining the library, or acquiring furniture, shelving, or
3131 equipment for the library; [or]
3232 (3) purchasing or leasing library materials or
3333 acquiring library equipment, including computers, software, and
3434 subscriptions to obtain access to electronic research networks for
3535 use by judges in the county; or
3636 (4) establishing and maintaining a self-help center to
3737 provide resources to county residents representing themselves in
3838 legal matters.
3939 SECTION 3. This Act takes effect immediately if it receives
4040 a vote of two-thirds of all the members elected to each house, as
4141 provided by Section 39, Article III, Texas Constitution. If this
4242 Act does not receive the vote necessary for immediate effect, this
4343 Act takes effect September 1, 2017.
