14 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

15 | 8 | | SECTION 1. Section 31.002(a), Civil Practice and Remedies |
---|
16 | 9 | | Code, is amended to read as follows: |
---|
17 | 10 | | (a) A judgment creditor is entitled to aid from a court of |
---|
18 | 11 | | appropriate jurisdiction through injunction or other means in order |
---|
19 | 12 | | to reach property to obtain satisfaction on the judgment if the |
---|
20 | 13 | | judgment debtor owns property, including present or future rights |
---|
21 | 14 | | to property, that[: |
---|
22 | 15 | | [(1) cannot readily be attached or levied on by |
---|
23 | 16 | | ordinary legal process; and |
---|
24 | 17 | | [(2)] is not exempt from attachment, execution, or |
---|
25 | 18 | | seizure for the satisfaction of liabilities. |
---|
26 | 19 | | SECTION 2. The change in law made by this Act applies to the |
---|
27 | 20 | | collection of any judgment, regardless of whether the judgment was |
---|
28 | 21 | | entered before, on, or after the effective date of this Act. |
---|
29 | 22 | | SECTION 3. This Act takes effect immediately if it receives |
---|
30 | 23 | | a vote of two-thirds of all the members elected to each house, as |
---|
31 | 24 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
32 | 25 | | Act does not receive the vote necessary for immediate effect, this |
---|
33 | 26 | | Act takes effect September 1, 2017. |
