125 relating to the collection of certain judgments through court
136 proceeding.
147 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
158 SECTION 1. Section 31.002(a), Civil Practice and Remedies
169 Code, is amended to read as follows:
1710 (a) A judgment creditor is entitled to aid from a court of
1811 appropriate jurisdiction through injunction or other means in order
1912 to reach property to obtain satisfaction on the judgment if the
2013 judgment debtor owns property, including present or future rights
2114 to property, that[:
2215 [(1) cannot readily be attached or levied on by
2316 ordinary legal process; and
2417 [(2)] is not exempt from attachment, execution, or
2518 seizure for the satisfaction of liabilities.
2619 SECTION 2. The change in law made by this Act applies to the
2720 collection of any judgment, regardless of whether the judgment was
2821 entered before, on, or after the effective date of this Act.
2922 SECTION 3. This Act takes effect immediately if it receives
3023 a vote of two-thirds of all the members elected to each house, as
3124 provided by Section 39, Article III, Texas Constitution. If this
3225 Act does not receive the vote necessary for immediate effect, this
3326 Act takes effect September 1, 2017.
