66 AN ACT
77 relating to the issuance of a permit to host a charity hunt outside
88 the regular hunting season; authorizing the imposition of a fee.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 43, Parks and Wildlife Code, is amended
1111 by adding Subchapter Y to read as follows:
1212 SUBCHAPTER Y. CHARITY HUNT PERMIT
1313 Sec. 43.961. DEFINITION. In this subchapter, "charitable
1414 nonprofit organization" means an organization that is exempt from
1515 federal income taxation under Section 501(a), Internal Revenue Code
1616 of 1986, by being listed as an exempt organization in Section
1717 501(c)(3) of that code.
1818 Sec. 43.962. APPLICATION FOR PERMIT. (a) A landowner may
1919 apply to the department for a permit to host a charity hunt
2020 occurring within two weeks after the end of an open hunting season
2121 to raise money for a charitable nonprofit organization.
2222 (b) The application for a permit to host a charity hunt must
2323 include:
2424 (1) the specific date of the hunt;
2525 (2) the event name, if applicable; and
2626 (3) the charitable nonprofit organization to which the
2727 money derived from the hunt will be donated.
2828 Sec. 43.963. PERMIT REQUIRED. No person may host a charity
2929 hunt under this subchapter unless the person holds a valid permit to
3030 host a charity hunt and a hunting license under Chapter 42.
3131 Sec. 43.964. ISSUANCE OF PERMIT; FEE. (a) The department
3232 may issue a permit to host a charity hunt under this subchapter.
3333 (b) The fee for filing an application for a permit to host a
3434 charity hunt is $100. If the department denies the application and
3535 the applicant elects not to proceed further, the department may
3636 order any part of the fee submitted with the application returned to
3737 the applicant.
3838 Sec. 43.965. DONATION OF PROCEEDS. (a) The landowner shall
3939 donate any proceeds the landowner receives from the charity hunt to
4040 the charitable nonprofit organization.
4141 (b) The department shall prescribe a form to be completed by
4242 the charitable nonprofit organization to prove the organization's
4343 status as a charitable nonprofit organization.
4444 Sec. 43.966. RULES. The commission may adopt any rules
4545 necessary to administer this subchapter.
4646 SECTION 2. Not later than October 1, 2017, the Parks and
4747 Wildlife Commission shall adopt any rules necessary to implement
4848 Subchapter Y, Chapter 43, Parks and Wildlife Code, as added by this
4949 Act.
5050 SECTION 3. This Act takes effect September 1, 2017.
