| 7 | 7 | | relating to the issuance of a permit to host a charity hunt outside |

| 8 | 8 | | the regular hunting season; authorizing the imposition of a fee. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 43, Parks and Wildlife Code, is amended |
|---|
| 11 | 11 | | by adding Subchapter Y to read as follows: |
|---|
| 12 | 12 | | SUBCHAPTER Y. CHARITY HUNT PERMIT |
|---|
| 13 | 13 | | Sec. 43.961. DEFINITION. In this subchapter, "charitable |
|---|
| 14 | 14 | | nonprofit organization" means an organization that is exempt from |
|---|
| 15 | 15 | | federal income taxation under Section 501(a), Internal Revenue Code |
|---|
| 16 | 16 | | of 1986, by being listed as an exempt organization in Section |
|---|
| 17 | 17 | | 501(c)(3) of that code. |
|---|
| 18 | 18 | | Sec. 43.962. APPLICATION FOR PERMIT. (a) A landowner may |
|---|
| 19 | 19 | | apply to the department for a permit to host a charity hunt |
|---|
| 20 | 20 | | occurring within two weeks after the end of an open hunting season |
|---|
| 21 | 21 | | to raise money for a charitable nonprofit organization. |
|---|
| 22 | 22 | | (b) The application for a permit to host a charity hunt must |
|---|
| 23 | 23 | | include: |
|---|
| 24 | 24 | | (1) the specific date of the hunt; |
|---|
| 25 | 25 | | (2) the event name, if applicable; and |
|---|
| 26 | 26 | | (3) the charitable nonprofit organization to which the |
|---|
| 27 | 27 | | money derived from the hunt will be donated. |
|---|
| 28 | 28 | | Sec. 43.963. PERMIT REQUIRED. No person may host a charity |
|---|
| 29 | 29 | | hunt under this subchapter unless the person holds a valid permit to |
|---|
| 30 | 30 | | host a charity hunt and a hunting license under Chapter 42. |
|---|
| 31 | 31 | | Sec. 43.964. ISSUANCE OF PERMIT; FEE. (a) The department |
|---|
| 32 | 32 | | may issue a permit to host a charity hunt under this subchapter. |
|---|
| 33 | 33 | | (b) The fee for filing an application for a permit to host a |
|---|
| 34 | 34 | | charity hunt is $100. If the department denies the application and |
|---|
| 35 | 35 | | the applicant elects not to proceed further, the department may |
|---|
| 36 | 36 | | order any part of the fee submitted with the application returned to |
|---|
| 37 | 37 | | the applicant. |
|---|
| 38 | 38 | | Sec. 43.965. DONATION OF PROCEEDS. (a) The landowner shall |
|---|
| 39 | 39 | | donate any proceeds the landowner receives from the charity hunt to |
|---|
| 40 | 40 | | the charitable nonprofit organization. |
|---|
| 41 | 41 | | (b) The department shall prescribe a form to be completed by |
|---|
| 42 | 42 | | the charitable nonprofit organization to prove the organization's |
|---|
| 43 | 43 | | status as a charitable nonprofit organization. |
|---|
| 44 | 44 | | Sec. 43.966. RULES. The commission may adopt any rules |
|---|
| 45 | 45 | | necessary to administer this subchapter. |
|---|
| 46 | 46 | | SECTION 2. Not later than October 1, 2017, the Parks and |
|---|
| 47 | 47 | | Wildlife Commission shall adopt any rules necessary to implement |
|---|
| 48 | 48 | | Subchapter Y, Chapter 43, Parks and Wildlife Code, as added by this |
|---|
| 49 | 49 | | Act. |
|---|
| 50 | 50 | | SECTION 3. This Act takes effect September 1, 2017. |
|---|
