 A BILL TO BE ENTITLED
 AN ACT
 relating to the issuance of a permit to host a charity hunt outside
 the regular hunting season; authorizing the imposition of a fee.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Chapter 43, Parks and Wildlife Code, is amended
 by adding Subchapter Y to read as follows:
 SUBCHAPTER Y. CHARITY HUNT PERMIT
 Sec. 43.961.  DEFINITION. In this subchapter, "charitable
 nonprofit organization" means an organization that is exempt from
 federal income taxation under Section 501(a), Internal Revenue Code
 of 1986, by being listed as an exempt organization in Section
 501(c)(3) of that code.
 Sec. 43.962.  APPLICATION FOR PERMIT. (a) A landowner may
 apply to the department for a permit to host a charity hunt
 occurring within two weeks after the end of an open hunting season
 to raise money for a charitable nonprofit organization.
 (b)  The application for a permit to host a charity hunt must
 include:
 (1)  the specific date of the hunt;
 (2)  the event name, if applicable; and
 (3)  the charitable nonprofit organization to which the
 money derived from the hunt will be donated.
 Sec. 43.963.  PERMIT REQUIRED. No person may host a charity
 hunt under this subchapter unless the person holds a valid permit to
 host a charity hunt and a hunting license under Chapter 42.
 Sec. 43.964.  ISSUANCE OF PERMIT; FEE. (a) The department
 may issue a permit to host a charity hunt under this subchapter.
 (b)  The fee for filing an application for a permit to host a
 charity hunt is $100. If the department denies the application and
 the applicant elects not to proceed further, the department may
 order any part of the fee submitted with the application returned to
 the applicant.
 Sec. 43.965.  DONATION OF PROCEEDS. (a) The landowner shall
 donate any proceeds the landowner receives from the charity hunt to
 the charitable nonprofit organization.
 (b)  The department shall prescribe a form to be completed by
 the charitable nonprofit organization to prove the organization's
 status as a charitable nonprofit organization.
 Sec. 43.966.  RULES. The commission may adopt any rules
 necessary to administer this subchapter.
 SECTION 2.  Not later than October 1, 2017, the Parks and
 Wildlife Commission shall adopt any rules necessary to implement
 Subchapter Y, Chapter 43, Parks and Wildlife Code, as added by this
 Act.
 SECTION 3.  This Act takes effect September 1, 2017.
