99 relating to providing a telephone number for certain governmental
1010 purposes.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Sections 13.004(a) and (c), Election Code, are
1313 amended to read as follows:
1414 (a) The registrar may [not] transcribe, copy, or otherwise
1515 record a telephone number furnished on a registration application
1616 only for purposes of reconstituting a jury wheel as provided by
1717 Sections 62.001 and 62.002, Government Code.
1818 (c) The following information furnished on a registration
1919 application is confidential and does not constitute public
2020 information for purposes of Chapter 552, Government Code:
2121 (1) a social security number;
2222 (2) a Texas driver's license number;
2323 (3) a number of a personal identification card issued
2424 by the Department of Public Safety;
2525 (4) an indication that an applicant is interested in
2626 working as an election judge; [or]
2727 (5) the residence address of the applicant, if the
2828 applicant is a federal judge or state judge, as defined by Section
2929 13.0021, the spouse of a federal judge or state judge, or an
3030 individual to whom Section 552.1175, Government Code, applies and
3131 the applicant:
3232 (A) included an affidavit with the registration
3333 application describing the applicant's status under this
3434 subdivision, including an affidavit under Section 13.0021 if the
3535 applicant is a federal judge or state judge or the spouse of a
3636 federal judge or state judge;
3737 (B) provided the registrar with an affidavit
3838 describing the applicant's status under this subdivision,
3939 including an affidavit under Section 15.0215 if the applicant is a
4040 federal judge or state judge or the spouse of a federal judge or
4141 state judge; or
4242 (C) provided the registrar with a completed form
4343 approved by the secretary of state for the purpose of notifying the
4444 registrar of the applicant's status under this subdivision; or
4545 (6) a telephone number.
4646 SECTION 2. Section 18.066(b), Election Code, is amended to
4747 read as follows:
4848 (b) Information furnished under this section may not
4949 include:
5050 (1) a voter's social security number; [or]
5151 (2) the residence address of a voter who is a federal
5252 judge or state judge, as defined by Section 13.0021, or the spouse
5353 of a federal judge or state judge, if the voter included an
5454 affidavit with the voter's registration application under Section
5555 13.0021 or the applicable registrar has received an affidavit
5656 submitted under Section 15.0215; or
5757 (3) a voter's telephone number.
5858 SECTION 3. Sections 62.001(c) and (i), Government Code, are
5959 amended to read as follows:
6060 (c) Each year not later than the third Tuesday in November
6161 or the date provided by Section 16.032, Election Code, for the
6262 cancellation of voter registrations, whichever is earlier, the
6363 voter registrar of each county shall furnish to the secretary of
6464 state a current voter registration list from all the precincts in
6565 the county that, except as provided by Subsection (d), includes:
6666 (1) the complete name, mailing address, date of birth,
6767 voter registration number, and precinct number for each voter;
6868 (2) if available, the Texas driver's license number or
6969 personal identification card or certificate number, [and] social
7070 security number, and telephone number for each voter; and
7171 (3) any other information included on the voter
7272 registration list of the county.
7373 (i) The commissioners court may, instead of using the method
7474 provided by Subsections (c) through (h), contract with another
7575 governmental unit or a private person to combine the voter
7676 registration list with the list furnished by the Department of
7777 Public Safety. Subsections (c) through (h) do not apply to a county
7878 in which the commissioners court has contracted with another
7979 governmental unit or a private person under this subsection. The
8080 Department of Public Safety may not charge a fee for furnishing a
8181 list under this subsection. Each list must contain the name, date
8282 of birth, address, county of residence, and citizenship status of
8383 each person listed and if available, the telephone number of each
8484 person. If practical, each list must contain any other information
8585 useful in determining if the person is qualified to serve as a
8686 juror.
8787 SECTION 4. Section 62.002, Government Code, is amended to
8888 read as follows:
8989 Sec. 62.002. JURY WHEEL CARDS. (a) The officials or their
9090 deputies who reconstitute the jury wheel shall write on a separate
9191 jury wheel card of uniform size and color the name and, if possible,
9292 the post office address and telephone number of each prospective
9393 juror that resides in the county and whose name appears on the
9494 current lists used under Section 62.001. The name of each
9595 prospective juror may appear on only one card.
9696 (b) In a county with a population of 140,000 or more, the
9797 commissioners court shall employ typists who shall type the names,
9898 [and] addresses, and if available, telephone numbers of qualified
9999 prospective jurors on separate jury wheel cards of uniform size and
100100 color under the direction and control of the district clerk. The
101101 expenses incurred in typing the names, [and] addresses, and
102102 telephone numbers must be authorized, reported, and paid and
103103 accounted for under the laws and rules that govern the payment of
104104 other expenses of the office of district clerk. The compensation of
105105 the typists and the expenses are paid from the jury fund.
106106 SECTION 5. This Act takes effect immediately if it receives
107107 a vote of two-thirds of all the members elected to each house, as
108108 provided by Section 39, Article III, Texas Constitution. If this
109109 Act does not receive the vote necessary for immediate effect, this
110110 Act takes effect September 1, 2017.
