77 relating to the use of a school as a polling place.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 43.031, Election Code, is amended by
1010 adding Subsection (f) to read as follows:
1111 (f) Notwithstanding Subsection (c), if the building
1212 selected for a polling place under this section is a school, the
1313 entity that owns or controls the building may deny the authority
1414 holding the election use of the building as a polling place if the
1515 entity that owns or controls the building can demonstrate that
1616 using the building as a polling place is reasonably likely to result
1717 in unsecured access to students on the building's campus. This
1818 subsection does not apply if classes are suspended during the time
1919 the building is in use as a polling place. The secretary of state
2020 shall adopt rules for the administration of this subsection.
2121 SECTION 2. This Act takes effect September 1, 2017.
