8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Section 43.031, Election Code, is amended by | |
10 | 10 | adding Subsection (f) to read as follows: | |
11 | 11 | (f) Notwithstanding Subsection (c), if the building | |
12 | 12 | selected for a polling place under this section is a school, the | |
13 | 13 | entity that owns or controls the building may deny the authority | |
14 | 14 | holding the election use of the building as a polling place if the | |
15 | 15 | entity that owns or controls the building can demonstrate that | |
16 | 16 | using the building as a polling place is reasonably likely to result | |
17 | 17 | in unsecured access to students on the building's campus. This | |
18 | 18 | subsection does not apply if classes are suspended during the time | |
19 | 19 | the building is in use as a polling place. The secretary of state | |
20 | 20 | shall adopt rules for the administration of this subsection. | |
21 | 21 | SECTION 2. This Act takes effect September 1, 2017. |
