104 AN ACT
115 relating to the definition of commercial property insurance for
126 purposes of certain provisions governing insurance rates and policy
137 forms.
148 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
159 SECTION 1. Section 2251.002, Insurance Code, is amended by
1610 amending Subdivision (1) and adding Subdivision (1-a) to read as
1711 follows:
1812 (1) "Commercial property insurance" means insurance
1913 coverage against loss caused by or resulting from loss, damage, or
2014 destruction of real or personal property provided through a
2115 commercial property insurance policy. The term includes any
2216 combination of:
2317 (A) commercial fire or allied lines;
2418 (B) commercial inland marine insurance;
2519 (C) commercial crime coverage;
2620 (D) boiler and machinery insurance other than
2721 explosion;
2822 (E) glass insurance provided as part of other
2923 coverage; and
3024 (F) as authorized by commissioner rule,
3125 insurance covering other perils or providing other coverages or
3226 other lines of first party property insurance.
3327 (1-a) "Disallowed expenses" includes:
3428 (A) administrative expenses, other than
3529 acquisition, loss control, and safety engineering expenses, that
3630 exceed 110 percent of the industry median for those expenses;
3731 (B) lobbying expenses;
3832 (C) advertising expenses, other than for
3933 advertising:
4034 (i) directly related to the services or
4135 products provided by the insurer; or
4236 (ii) designed and directed at loss
4337 prevention;
4438 (D) amounts paid by an insurer:
4539 (i) as damages in an action brought against
4640 the insurer for bad faith, fraud, or any matters other than payment
4741 under the insurance contract; or
4842 (ii) as fees, fines, penalties, or
4943 exemplary damages for a civil or criminal violation of law;
5044 (E) contributions to:
5145 (i) social, religious, political, or
5246 fraternal organizations; or
5347 (ii) organizations engaged in legislative
5448 advocacy;
5549 (F) except as authorized by commissioner rule,
5650 fees and assessments paid to advisory organizations;
5751 (G) any amount determined by the commissioner to
5852 be excess premiums charged by the insurer; and
5953 (H) any unreasonably incurred expenses, as
6054 determined by the commissioner after notice and hearing.
6155 SECTION 2. Section 2301.002, Insurance Code, is amended by
6256 amending Subdivision (1) and adding Subdivision (1-a) to read as
6357 follows:
6458 (1) "Commercial property insurance" means insurance
6559 coverage against loss caused by or resulting from loss, damage, or
6660 destruction of real or personal property provided through a
6761 commercial property insurance policy. The term includes any
6862 combination of:
6963 (A) commercial fire or allied lines;
7064 (B) commercial inland marine insurance;
7165 (C) commercial crime coverage;
7266 (D) boiler and machinery insurance other than
7367 explosion;
7468 (E) glass insurance provided as part of other
7569 coverage; and
7670 (F) as authorized by commissioner rule,
7771 insurance covering other perils or providing other coverages or
7872 other lines of first party property insurance.
7973 (1-a) "Form" means an insurance policy form or a
8074 printed endorsement form.
8175 SECTION 3. This Act takes effect immediately if it receives
8276 a vote of two-thirds of all the members elected to each house, as
8377 provided by Section 39, Article III, Texas Constitution. If this
8478 Act does not receive the vote necessary for immediate effect, this
8579 Act takes effect September 1, 2017.
