55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to reporting concerning certain inmates who are confined
88 in county jails for misdemeanor offenses.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 511.0101, Government Code, is amended by
1111 amending Subsection (a) and adding Subsection (c) to read as
1212 follows:
1313 (a) Each county shall submit to the commission on or before
1414 the fifth day of each month a report containing the following
1515 information:
1616 (1) the number of prisoners confined in the county
1717 jail on the first day of the month, classified on the basis of the
1818 following categories:
1919 (A) total prisoners;
2020 (B) pretrial Class C misdemeanor offenders;
2121 (C) pretrial Class A and B misdemeanor offenders;
2222 (D) convicted Class C misdemeanor offenders;
2323 (E) convicted Class A and B misdemeanor
2424 offenders;
2525 (F) felony offenders whose penalty has been
2626 reduced to a misdemeanor;
2727 (G) [(F)] pretrial felony offenders;
2828 (H) [(G)] convicted felony offenders;
2929 (I) [(H)] prisoners detained on bench warrants;
3030 (J) [(I)] prisoners detained for parole
3131 violations;
3232 (K) [(J)] prisoners detained for federal
3333 officers;
3434 (L) [(K)] prisoners awaiting transfer to the
3535 institutional division of the Texas Department of Criminal Justice
3636 following conviction of a felony or revocation of probation,
3737 parole, or release on mandatory supervision and for whom paperwork
3838 and processing required for transfer have been completed;
3939 (M) [(L)] prisoners detained after having been
4040 transferred from another jail and for whom the commission has made a
4141 payment under Subchapter F, Chapter 499[, Government Code];
4242 (N) [(M)] prisoners for whom an immigration
4343 detainer has been issued by United States Immigration and Customs
4444 Enforcement; and
4545 (O) [(N)] other prisoners;
4646 (2) the total capacity of the county jail on the first
4747 day of the month;
4848 (3) the total number of prisoners who were confined in
4949 the county jail during the preceding month, based on a count
5050 conducted on each day of that month, who were known or had been
5151 determined to be pregnant;
5252 (4) the total cost to the county during the preceding
5353 month of housing prisoners described by Subdivision (1)(N)
5454 [(1)(M)], calculated based on the average daily cost of housing a
5555 prisoner in the county jail; and
5656 (5) certification by the reporting official that the
5757 information in the report is accurate.
5858 (c) The commission shall make the information reported
5959 under Subsection (a) available on the commission's Internet
6060 website.
6161 SECTION 2. A county shall submit the first report required
6262 by Section 511.0101, Government Code, as amended by this Act, not
6363 later than October 5, 2017.
6464 SECTION 3. This Act takes effect September 1, 2017.
