| 13 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 8 | | SECTION 1. Subchapter A, Chapter 213, Labor Code, is |
|---|
| 15 | 9 | | amended by adding Section 213.012 to read as follows: |
|---|
| 16 | 10 | | Sec. 213.012. RESTRICTIONS OR CONDITIONS ON PAYMENTS |
|---|
| 17 | 11 | | PROHIBITED. (a) In this section, "payment instrument" has the |
|---|
| 18 | 12 | | meaning assigned by Section 151.301, Finance Code. |
|---|
| 19 | 13 | | (b) A person may not place on a payment instrument remitted |
|---|
| 20 | 14 | | to the commission any restriction or condition purporting to limit |
|---|
| 21 | 15 | | the amount of contributions, penalties, or interest owed to the |
|---|
| 22 | 16 | | commission by an employer. |
|---|
| 23 | 17 | | (c) A restriction or condition in violation of this section |
|---|
| 24 | 18 | | is void. |
|---|
| 25 | 19 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 26 | 20 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 27 | 21 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 28 | 22 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 29 | 23 | | Act takes effect September 1, 2017. |
