115 relating to restrictions or conditions on certain payments to the
126 Texas Workforce Commission.
137 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
148 SECTION 1. Subchapter A, Chapter 213, Labor Code, is
159 amended by adding Section 213.012 to read as follows:
1610 Sec. 213.012. RESTRICTIONS OR CONDITIONS ON PAYMENTS
1711 PROHIBITED. (a) In this section, "payment instrument" has the
1812 meaning assigned by Section 151.301, Finance Code.
1913 (b) A person may not place on a payment instrument remitted
2014 to the commission any restriction or condition purporting to limit
2115 the amount of contributions, penalties, or interest owed to the
2216 commission by an employer.
2317 (c) A restriction or condition in violation of this section
2418 is void.
2519 SECTION 2. This Act takes effect immediately if it receives
2620 a vote of two-thirds of all the members elected to each house, as
2721 provided by Section 39, Article III, Texas Constitution. If this
2822 Act does not receive the vote necessary for immediate effect, this
2923 Act takes effect September 1, 2017.
