88 AN ACT
99 relating to a biennial report on stormwater infrastructure in this
1010 state.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter D, Chapter 5, Water Code, is amended
1313 by adding Section 5.136 to read as follows:
1414 Sec. 5.136. BIENNIAL REPORT ON STORMWATER INFRASTRUCTURE.
1515 (a) In this section, the term "green stormwater infrastructure,"
1616 also known as "low impact development," means systems and practices
1717 that:
1818 (1) use or mimic natural processes that result in the
1919 infiltration, evapotranspiration, treatment, or use of stormwater;
2020 (2) manage stormwater, protect water quality and
2121 associated habitat, or augment or replace conventional engineered
2222 stormwater systems;
2323 (3) meet local requirements for post-development
2424 stormwater retention and detention and erosion management; and
2525 (4) are considered best management practices.
2626 (b) Each state fiscal biennium the commission shall appoint
2727 a Green Stormwater Infrastructure and Low Impact Development Report
2828 Group to prepare a report on the use of green stormwater
2929 infrastructure and low impact development in this state. Each
3030 group must be composed of 10 members appointed by the commission,
3131 with one member to represent each of the following:
3232 (1) counties;
3333 (2) municipalities;
3434 (3) special districts that have land development
3535 authority or provide water or wastewater services;
3636 (4) academic university programs related to land
3737 development;
3838 (5) businesses engaged in real estate development;
3939 (6) civil engineers;
4040 (7) landscape architects;
4141 (8) environmental groups;
4242 (9) professional organizations focused on water
4343 conservation; and
4444 (10) vendors and providers of green stormwater
4545 infrastructure and low impact development systems or practices.
4646 (c) The commission shall solicit nominations for group
4747 members from the entities listed in Subsection (b). The commission
4848 may not appoint a person to serve as a group member representing a
4949 type of entity unless the person is nominated by a representative of
5050 that type of entity.
5151 (d) Each report must include:
5252 (1) a list of each county, municipality, and special
5353 district with land development authority that allows the use of
5454 green stormwater infrastructure and low impact development in land
5555 development projects in the county, municipal, or district
5656 territory;
5757 (2) estimates of:
5858 (A) the number of private and public projects and
5959 sites in this state that use green stormwater infrastructure and
6060 low impact development;
6161 (B) the amount of stormwater that is managed by
6262 the green stormwater infrastructure and low impact development
6363 features described in Paragraph (A); and
6464 (C) the amount of money invested in the green
6565 stormwater infrastructure and low impact development features
6666 described in Paragraph (A);
6767 (3) a monetized assessment of the social, economic,
6868 and environmental benefits realized by the use of green stormwater
6969 infrastructure and low impact development in this state;
7070 (4) an assessment of typical impediments to the use of
7171 green stormwater infrastructure and low impact development in local
7272 development codes;
7373 (5) an assessment of impediments in the law and
7474 policies of this state to the use of green stormwater
7575 infrastructure and low impact development; and
7676 (6) recommendations to encourage increased use and
7777 deployment of green stormwater infrastructure and low impact
7878 development in this state.
7979 (e) The commission shall:
8080 (1) publicly solicit information to support the
8181 preparation of the report; and
8282 (2) cooperate with the group in providing information
8383 or access to information.
8484 (f) The group shall:
8585 (1) conduct at least one meeting to receive input on
8686 the preparation of the report;
8787 (2) prepare a draft report;
8888 (3) publish the draft report and solicit comments on
8989 the draft report;
9090 (4) prepare a response-to-comments document and
9191 finalize the report; and
9292 (5) not later than January 1 of the second year of the
9393 state fiscal biennium, submit the final report to:
9494 (A) each member of the commission;
9595 (B) the governor;
9696 (C) the lieutenant governor;
9797 (D) the speaker of the house of representatives;
9898 and
9999 (E) each member of the legislature.
100100 SECTION 2. (a) The Texas Commission on Environmental
101101 Quality shall appoint the members of the first Green Stormwater
102102 Infrastructure and Low Impact Development Report Group under
103103 Section 5.136, Water Code, as added by this Act, in a timely manner
104104 to ensure that the group is able to prepare the report by January 1,
105105 2019.
106106 (b) Notwithstanding Section 5.136(d), Water Code, as added
107107 by this Act, the first biennial report prepared by the Green
108108 Stormwater Infrastructure and Low Impact Development Report Group
109109 is required to include only information described by Section
110110 5.136(d), Water Code, as added by this Act, that the Texas
111111 Commission on Environmental Quality requires to be in the report.
112112 SECTION 3. This Act takes effect immediately if it receives
113113 a vote of two-thirds of all the members elected to each house, as
114114 provided by Section 39, Article III, Texas Constitution. If this
115115 Act does not receive the vote necessary for immediate effect, this
116116 Act takes effect September 1, 2017.
