10	4		AN ACT
11	5		relating to conditions of community supervision for defendants
12	6		convicted of certain criminal offenses involving animals;
13	7		authorizing fees.
14	8		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
15	9		SECTION 1. Article 42A.511, Code of Criminal Procedure, is
16	10		amended to read as follows:
17	11		Art. 42A.511. COMMUNITY SUPERVISION FOR CERTAIN OFFENSES
18	12		INVOLVING ANIMALS. (a) If a judge grants community supervision to
19	13		a defendant convicted of an offense under Section 42.09, 42.091,
20	14		42.092, or 42.10, Penal Code, the judge may require the defendant
21	15		to:
22	16		(1) complete an online responsible pet owner course
23	17		approved and certified by the Texas Department of Licensing and
24	18		Regulation; or
25	19		(2) attend a responsible pet owner course sponsored by
26	20		a municipal animal shelter, as defined by Section 823.001, Health
27	21		and Safety Code, that:
28	22		(A) [(1)] receives federal, state, county, or
29	23		municipal funds; and
30	24		(B) [(2)] serves the county in which the court is
31	25		located.
32	26		(b) For purposes of the online responsible pet owner course
33	27		described by Subsection (a)(1), the Texas Department of Licensing
34	28		and Regulation or the Texas Commission of Licensing and Regulation,
35	29		as appropriate:
36	30		(1) is responsible for the approval, certification,
37	31		and administration of the course and course providers;
38	32		(2) may charge fees for:
39	33		(A) initial and renewal course certifications;
40	34		(B) initial and renewal course provider
41	35		certifications;
42	36		(C) course participant completion certificates;
43	37		and
44	38		(D) other fees necessary for the administration
45	39		of the course and course providers;
46	40		(3) shall adopt rules regarding the administration of
47	41		the course and course providers, including rules regarding:
48	42		(A) the criteria for course approval and
49	43		certification;
50	44		(B) the criteria for course provider approval and
51	45		certification;
52	46		(C) curriculum development;
53	47		(D) course length and content;
54	48		(E) criteria for a participant to complete the
55	49		course; and
56	50		(F) a course completion certificate that is
57	51		acceptable to a court;
58	52		(4) is authorized to monitor and audit the provision
59	53		of the course by the course providers; and
60	54		(5) may take enforcement actions as appropriate to
61	55		enforce this subsection.
62	56		SECTION 2. Not later than March 1, 2018, the Texas
63	57		Department of Licensing and Regulation or the Texas Commission of
64	58		Licensing and Regulation, as appropriate, shall adopt rules to
65	59		implement Article 42A.511, Code of Criminal Procedure, as amended
66	60		by this Act.
67	61		SECTION 3. This Act takes effect September 1, 2017.
