104 AN ACT
115 relating to conditions of community supervision for defendants
126 convicted of certain criminal offenses involving animals;
137 authorizing fees.
148 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
159 SECTION 1. Article 42A.511, Code of Criminal Procedure, is
1610 amended to read as follows:
1711 Art. 42A.511. COMMUNITY SUPERVISION FOR CERTAIN OFFENSES
1812 INVOLVING ANIMALS. (a) If a judge grants community supervision to
1913 a defendant convicted of an offense under Section 42.09, 42.091,
2014 42.092, or 42.10, Penal Code, the judge may require the defendant
2115 to:
2216 (1) complete an online responsible pet owner course
2317 approved and certified by the Texas Department of Licensing and
2418 Regulation; or
2519 (2) attend a responsible pet owner course sponsored by
2620 a municipal animal shelter, as defined by Section 823.001, Health
2721 and Safety Code, that:
2822 (A) [(1)] receives federal, state, county, or
2923 municipal funds; and
3024 (B) [(2)] serves the county in which the court is
3125 located.
3226 (b) For purposes of the online responsible pet owner course
3327 described by Subsection (a)(1), the Texas Department of Licensing
3428 and Regulation or the Texas Commission of Licensing and Regulation,
3529 as appropriate:
3630 (1) is responsible for the approval, certification,
3731 and administration of the course and course providers;
3832 (2) may charge fees for:
3933 (A) initial and renewal course certifications;
4034 (B) initial and renewal course provider
4135 certifications;
4236 (C) course participant completion certificates;
4337 and
4438 (D) other fees necessary for the administration
4539 of the course and course providers;
4640 (3) shall adopt rules regarding the administration of
4741 the course and course providers, including rules regarding:
4842 (A) the criteria for course approval and
4943 certification;
5044 (B) the criteria for course provider approval and
5145 certification;
5246 (C) curriculum development;
5347 (D) course length and content;
5448 (E) criteria for a participant to complete the
5549 course; and
5650 (F) a course completion certificate that is
5751 acceptable to a court;
5852 (4) is authorized to monitor and audit the provision
5953 of the course by the course providers; and
6054 (5) may take enforcement actions as appropriate to
6155 enforce this subsection.
6256 SECTION 2. Not later than March 1, 2018, the Texas
6357 Department of Licensing and Regulation or the Texas Commission of
6458 Licensing and Regulation, as appropriate, shall adopt rules to
6559 implement Article 42A.511, Code of Criminal Procedure, as amended
6660 by this Act.
6761 SECTION 3. This Act takes effect September 1, 2017.
