9- A BILL TO BE ENTITLED
104 AN ACT
115 relating to reporting requirements for investigations of abuse,
126 neglect, or exploitation against residents of certain health
137 facilities.
148 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
159 SECTION 1. Section 260A.007(k), Health and Safety Code, is
1610 amended to read as follows:
1711 (k) If the department determines the report of abuse,
1812 neglect, or exploitation is substantiated at the conclusion of the
1913 investigation, the [The] department shall make a complete final
2014 written report of the investigation and submit the report and its
2115 recommendations to the [district attorney and, if a law enforcement
2216 agency has not investigated the report of abuse, neglect,
2317 exploitation, or other complaint, to the] appropriate law
2418 enforcement agency.
2519 SECTION 2. The changes in law made by this Act apply only to
2620 an investigation completed on or after the effective date of this
2721 Act.
2822 SECTION 3. This Act takes effect September 1, 2017.
