97 AN ACT
108 relating to the operation of a public transit motor bus by certain
119 mass transit entities on an improved shoulder.
1210 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1311 SECTION 1. Section 545.058(c), Transportation Code, is
1412 amended to read as follows:
1513 (c) A limitation in this section on driving on an improved
1614 shoulder does not apply to:
1715 (1) an authorized emergency vehicle responding to a
1816 call;
1917 (2) a police patrol; [or]
2018 (3) a bicycle; or
2119 (4) a public transit motor bus of a mass transit entity
2220 operating under Subtitle K, Title 6, if the motor bus is:
2321 (A) operating within the boundaries of a
2422 metropolitan planning organization in which:
2523 (i) at least five counties are located; and
2624 (ii) the two counties with the largest
2725 populations are part of a regional mobility authority governed by
2826 Chapter 370; and
2927 (B) bypassing traffic by operating on the
3028 shoulder of a highway designated by the Texas Department of
3129 Transportation that is under construction.
3230 SECTION 2. This Act takes effect September 1, 2017.
