| 12 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 11 | | SECTION 1. Section 545.058(c), Transportation Code, is |
|---|
| 14 | 12 | | amended to read as follows: |
|---|
| 15 | 13 | | (c) A limitation in this section on driving on an improved |
|---|
| 16 | 14 | | shoulder does not apply to: |
|---|
| 17 | 15 | | (1) an authorized emergency vehicle responding to a |
|---|
| 18 | 16 | | call; |
|---|
| 19 | 17 | | (2) a police patrol; [or] |
|---|
| 20 | 18 | | (3) a bicycle; or |
|---|
| 21 | 19 | | (4) a public transit motor bus of a mass transit entity |
|---|
| 22 | 20 | | operating under Subtitle K, Title 6, if the motor bus is: |
|---|
| 23 | 21 | | (A) operating within the boundaries of a |
|---|
| 24 | 22 | | metropolitan planning organization in which: |
|---|
| 25 | 23 | | (i) at least five counties are located; and |
|---|
| 26 | 24 | | (ii) the two counties with the largest |
|---|
| 27 | 25 | | populations are part of a regional mobility authority governed by |
|---|
| 28 | 26 | | Chapter 370; and |
|---|
| 29 | 27 | | (B) bypassing traffic by operating on the |
|---|
| 30 | 28 | | shoulder of a highway designated by the Texas Department of |
|---|
| 31 | 29 | | Transportation that is under construction. |
|---|
| 32 | 30 | | SECTION 2. This Act takes effect September 1, 2017. |
