14 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

15 | 8 | | SECTION 1. Title 7, Parks and Wildlife Code, is amended by |
---|
16 | 9 | | adding Chapter 287 to read as follows: |
---|
17 | 10 | | CHAPTER 287. POTTER COUNTY |
---|
18 | 11 | | Sec. 287.001. DISCHARGE OF FIREARM PROHIBITED. (a) In this |
---|
19 | 12 | | section, "firearm" has the meaning assigned by Section 62.014. |
---|
20 | 13 | | (b) This section applies only to the segment of the Canadian |
---|
21 | 14 | | River extending from the intersection of United States Highways 287 |
---|
22 | 15 | | and 87 and the Canadian River to: |
---|
23 | 16 | | (1) a point 1.2 miles west of the intersection, marked |
---|
24 | 17 | | by a structure serving as a railroad trestle; and |
---|
25 | 18 | | (2) a point 1.5 miles east of the intersection, where |
---|
26 | 19 | | the Canadian River enters the Lake Meredith National Recreational |
---|
27 | 20 | | Area. |
---|
28 | 21 | | (c) Except as provided by Subsection (d), a person may not |
---|
29 | 22 | | discharge a firearm or shoot an arrow from any kind of bow if the |
---|
30 | 23 | | person is located in or on the bed or bank of the portion of the |
---|
31 | 24 | | Canadian River to which this chapter applies at the time the firearm |
---|
32 | 25 | | is discharged or the arrow is shot from the bow. |
---|
33 | 26 | | (d) This section does not apply to: |
---|
34 | 27 | | (1) an individual acting in the scope of the |
---|
35 | 28 | | individual's duties as a peace officer or department employee; or |
---|
36 | 29 | | (2) the discharge of a shotgun loaded with ammunition |
---|
37 | 30 | | that releases only shot when discharged. |
---|
38 | 31 | | (e) This section does not limit the ability of a license |
---|
39 | 32 | | holder to carry a concealed handgun under the authority of |
---|
40 | 33 | | Subchapter H, Chapter 411, Government Code. |

41 | 34 | | SECTION 2. This Act takes effect September 1, 2017. |
