11 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 10 | | SECTION 1. Subchapter C, Chapter 3891, Special District |
---|
13 | 11 | | Local Laws Code, is amended by adding Section 3891.109 to read as |
---|
14 | 12 | | follows: |
---|
15 | 13 | | Sec. 3891.109. ENFORCEMENT OF REAL PROPERTY RESTRICTIONS. |
---|
16 | 14 | | The district may enforce a real property restriction in the manner |
---|
17 | 15 | | provided by Section 54.237, Water Code, if, in the reasonable |
---|
18 | 16 | | judgment of the board, the enforcement of the restriction is |
---|
19 | 17 | | necessary. |
---|
20 | 18 | | SECTION 2. Section 3891.153, Special District Local Laws |
---|
21 | 19 | | Code, is amended to read as follows: |
---|
22 | 20 | | Sec. 3891.153. AUTHORITY TO ISSUE BONDS AND OTHER |
---|
23 | 21 | | OBLIGATIONS. (a) The district may issue bonds, notes, or other |
---|
24 | 22 | | obligations payable wholly or partly from ad valorem taxes, sales |
---|
25 | 23 | | and use taxes, assessments, impact fees, revenue, contract |
---|
26 | 24 | | payments, grants, or other district money, or any combination of |
---|
27 | 25 | | those sources of money, to pay for any authorized district purpose. |
---|
28 | 26 | | (b) The limitation on the outstanding principal amount of |
---|
29 | 27 | | bonds, notes, and other obligations provided by Section 49.4645, |
---|
30 | 28 | | Water Code, does not apply to the district. |
---|
31 | 29 | | SECTION 3. Subchapter D, Chapter 3891, Special District |
---|
32 | 30 | | Local Laws Code, is amended by adding Section 3891.159 to read as |
---|
33 | 31 | | follows: |
---|
34 | 32 | | Sec. 3891.159. POWERS OF MUNICIPAL UTILITY DISTRICT TO |
---|
35 | 33 | | ESTABLISH DEFINED AREAS AND DESIGNATED PROPERTY; TAXES; BONDS. (a) |
---|
36 | 34 | | The district has the powers of a municipal utility district under |
---|
37 | 35 | | Subchapter J, Chapter 54, Water Code, including the power to: |
---|
38 | 36 | | (1) implement a plan; |
---|
39 | 37 | | (2) issue bonds; and |
---|
40 | 38 | | (3) impose a tax in a defined area established under |
---|
41 | 39 | | that subchapter. |
---|
42 | 40 | | (b) The district may exercise the powers described by |
---|
43 | 41 | | Subsection (a) regardless of whether the district is composed of |
---|
44 | 42 | | the minimum number of acres provided by Section 54.801, Water Code. |
---|
45 | 43 | | SECTION 4. (a) The legal notice of the intention to |
---|
46 | 44 | | introduce this Act, setting forth the general substance of this |
---|
47 | 45 | | Act, has been published as provided by law, and the notice and a |
---|
48 | 46 | | copy of this Act have been furnished to all persons, agencies, |
---|
49 | 47 | | officials, or entities to which they are required to be furnished |
---|
50 | 48 | | under Section 59, Article XVI, Texas Constitution, and Chapter 313, |
---|
51 | 49 | | Government Code. |
---|
52 | 50 | | (b) The governor, one of the required recipients, has |
---|
53 | 51 | | submitted the notice and Act to the Texas Commission on |
---|
54 | 52 | | Environmental Quality. |
---|
55 | 53 | | (c) The Texas Commission on Environmental Quality has filed |
---|
56 | 54 | | its recommendations relating to this Act with the governor, |
---|
57 | 55 | | lieutenant governor, and speaker of the house of representatives |
---|
58 | 56 | | within the required time. |
---|
59 | 57 | | (d) The general law relating to consent by political |
---|
60 | 58 | | subdivisions to the creation of districts with conservation, |
---|
61 | 59 | | reclamation, and road powers and the inclusion of land in those |
---|
62 | 60 | | districts has been complied with. |
---|
63 | 61 | | (e) All requirements of the constitution and laws of this |
---|
64 | 62 | | state and the rules and procedures of the legislature with respect |
---|
65 | 63 | | to the notice, introduction, and passage of this Act have been |
---|
66 | 64 | | fulfilled and accomplished. |
---|
67 | 65 | | SECTION 5. This Act takes effect immediately if it receives |
---|
68 | 66 | | a vote of two-thirds of all the members elected to each house, as |
---|
69 | 67 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
70 | 68 | | Act does not receive the vote necessary for immediate effect, this |
---|
71 | 69 | | Act takes effect September 1, 2017. |
---|
