119 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1210 SECTION 1. Subchapter C, Chapter 3891, Special District
1311 Local Laws Code, is amended by adding Section 3891.109 to read as
1412 follows:
1513 Sec. 3891.109. ENFORCEMENT OF REAL PROPERTY RESTRICTIONS.
1614 The district may enforce a real property restriction in the manner
1715 provided by Section 54.237, Water Code, if, in the reasonable
1816 judgment of the board, the enforcement of the restriction is
1917 necessary.
2018 SECTION 2. Section 3891.153, Special District Local Laws
2119 Code, is amended to read as follows:
2220 Sec. 3891.153. AUTHORITY TO ISSUE BONDS AND OTHER
2321 OBLIGATIONS. (a) The district may issue bonds, notes, or other
2422 obligations payable wholly or partly from ad valorem taxes, sales
2523 and use taxes, assessments, impact fees, revenue, contract
2624 payments, grants, or other district money, or any combination of
2725 those sources of money, to pay for any authorized district purpose.
2826 (b) The limitation on the outstanding principal amount of
2927 bonds, notes, and other obligations provided by Section 49.4645,
3028 Water Code, does not apply to the district.
3129 SECTION 3. Subchapter D, Chapter 3891, Special District
3230 Local Laws Code, is amended by adding Section 3891.159 to read as
3331 follows:
3432 Sec. 3891.159. POWERS OF MUNICIPAL UTILITY DISTRICT TO
3533 ESTABLISH DEFINED AREAS AND DESIGNATED PROPERTY; TAXES; BONDS. (a)
3634 The district has the powers of a municipal utility district under
3735 Subchapter J, Chapter 54, Water Code, including the power to:
3836 (1) implement a plan;
3937 (2) issue bonds; and
4038 (3) impose a tax in a defined area established under
4139 that subchapter.
4240 (b) The district may exercise the powers described by
4341 Subsection (a) regardless of whether the district is composed of
4442 the minimum number of acres provided by Section 54.801, Water Code.
4543 SECTION 4. (a) The legal notice of the intention to
4644 introduce this Act, setting forth the general substance of this
4745 Act, has been published as provided by law, and the notice and a
4846 copy of this Act have been furnished to all persons, agencies,
4947 officials, or entities to which they are required to be furnished
5048 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
5149 Government Code.
5250 (b) The governor, one of the required recipients, has
5351 submitted the notice and Act to the Texas Commission on
5452 Environmental Quality.
5553 (c) The Texas Commission on Environmental Quality has filed
5654 its recommendations relating to this Act with the governor,
5755 lieutenant governor, and speaker of the house of representatives
5856 within the required time.
5957 (d) The general law relating to consent by political
6058 subdivisions to the creation of districts with conservation,
6159 reclamation, and road powers and the inclusion of land in those
6260 districts has been complied with.
6361 (e) All requirements of the constitution and laws of this
6462 state and the rules and procedures of the legislature with respect
6563 to the notice, introduction, and passage of this Act have been
6664 fulfilled and accomplished.
6765 SECTION 5. This Act takes effect immediately if it receives
6866 a vote of two-thirds of all the members elected to each house, as
6967 provided by Section 39, Article III, Texas Constitution. If this
7068 Act does not receive the vote necessary for immediate effect, this
7169 Act takes effect September 1, 2017.
