104 AN ACT
115 relating to the powers and compensation of criminal law magistrates
126 in Tarrant County.
137 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
148 SECTION 1. Section 54.653, Government Code, is amended to
159 read as follows:
1610 Sec. 54.653. COMPENSATION. (a) A full-time magistrate is
1711 entitled to the salary determined by the Commissioners Court of
1812 Tarrant County.
1913 (b) The salary of a full-time magistrate may not exceed 90
2014 percent of the sum of:
2115 (1) [be less than] the salary [authorized to be] paid
2216 to a district judge by the state under Section 659.012; and
2317 (2) the maximum amount of county contributions and
2418 supplements allowed by law to be paid to a district judge under
2519 Section 659.012 [master for family law cases appointed under
2620 Subchapter A].
2721 (c) The salary of a part-time magistrate is equal to the
2822 per-hour salary of a full-time magistrate. The per-hour salary is
2923 determined by dividing the annual salary by a 2,080 work-hour year.
3024 The judges of the courts trying criminal cases in Tarrant County
3125 shall approve the number of hours for which a part-time magistrate
3226 is to be paid.
3327 (d) A [The] magistrate's salary is paid from the county fund
3428 available for payment of officers' salaries.
3529 SECTION 2. Section 54.656(a), Government Code, is amended
3630 to read as follows:
3731 (a) A judge may refer to a magistrate any criminal case or
3832 matter relating to a criminal case for proceedings involving:
3933 (1) a negotiated plea of guilty or no contest and
4034 sentencing before the court;
4135 (2) a bond forfeiture, remittitur, and related
4236 proceedings;
4337 (3) a pretrial motion;
4438 (4) a [postconviction] writ of habeas corpus;
4539 (5) an examining trial;
4640 (6) an occupational driver's license;
4741 (7) a petition for an [agreed] order of expunction
4842 under Chapter 55, Code of Criminal Procedure;
4943 (8) an asset forfeiture hearing as provided by Chapter
5044 59, Code of Criminal Procedure;
5145 (9) a petition for an [agreed] order of nondisclosure
5246 of criminal history record information or an order of nondisclosure
5347 of criminal history record information that does not require a
5448 petition provided by Subchapter E-1, Chapter 411;
5549 (10) a [hearing on a] motion to modify or revoke
5650 community supervision or to proceed with an adjudication of guilt
5751 [probation]; [and]
5852 (11) setting conditions, modifying, revoking, and
5953 surrendering of bonds, including surety bonds;
6054 (12) specialty court proceedings;
6155 (13) a waiver of extradition; and
6256 (14) any other matter the judge considers necessary
6357 and proper.
6458 SECTION 3. Section 54.658, Government Code, is amended to
6559 read as follows:
6660 Sec. 54.658. POWERS. (a) Except as limited by an order of
6761 referral, a magistrate to whom a case is referred may:
6862 (1) conduct hearings;
6963 (2) hear evidence;
7064 (3) compel production of relevant evidence;
7165 (4) rule on admissibility of evidence;
7266 (5) issue summons for the appearance of witnesses;
7367 (6) examine witnesses;
7468 (7) swear witnesses for hearings;
7569 (8) make findings of fact on evidence;
7670 (9) formulate conclusions of law;
7771 (10) rule on a pretrial motion;
7872 (11) recommend the rulings, orders, or judgment to be
7973 made in a case;
8074 (12) regulate proceedings in a hearing;
8175 (13) accept a plea of guilty from a defendant charged
8276 with misdemeanor, felony, or both misdemeanor and felony offenses;
8377 (14) select a jury;
8478 (15) accept a negotiated plea on a probation
8579 revocation;
8680 (16) conduct a contested probation revocation
8781 hearing;
8882 (17) sign a dismissal in a misdemeanor case; [and]
8983 (18) in any case referred under Section 54.656(a)(1),
9084 accept a negotiated plea of guilty or no contest and:
9185 (A) enter a finding of guilt and impose or
9286 suspend the sentence; or
9387 (B) defer adjudication of guilt; and
9488 (19) do any act and take any measure necessary and
9589 proper for the efficient performance of the duties required by the
9690 order of referral.
9791 (b) A magistrate may sign a motion to dismiss submitted by
9892 an attorney representing the state on cases referred to the
9993 magistrate, or on dockets called by the magistrate, and may
10094 consider unadjudicated cases at sentencing under Section 12.45,
10195 Penal Code.
10296 (c) A magistrate has all of the powers of a magistrate under
10397 the laws of this state and may administer an oath for any purpose.
10498 (d) A magistrate does not have authority under Article
10599 18.01(c), Code of Criminal Procedure, to issue a subsequent search
106100 warrant under Article 18.02(10), Code of Criminal Procedure.
107101 SECTION 4. The changes in law made by Sections 2 and 3 of
108102 this Act apply to a matter or case referred to a magistrate on or
109103 after the effective date of this Act. A matter or case referred to a
110104 magistrate before the effective date of this Act is governed by the
111105 law in effect immediately before that date, and that law is
112106 continued in effect for that purpose.
113107 SECTION 5. This Act takes effect September 1, 2017.
