| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Sections 41.001(b) and (c), Election Code, are |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (b) Subsection (a) does not apply to: |
|---|
| 13 | 13 | | (1) a runoff election; |
|---|
| 14 | 14 | | (2) an election to resolve a tie vote; |
|---|
| 15 | 15 | | (3) an election held under an order of a court or other |
|---|
| 16 | 16 | | tribunal; |
|---|
| 17 | 17 | | (4) an emergency election ordered under Section |
|---|
| 18 | 18 | | 41.0011; |
|---|
| 19 | 19 | | (5) an expedited election to fill a vacancy in the |
|---|
| 20 | 20 | | legislature held under Section 203.013; or |
|---|
| 21 | 21 | | (6) [an election held under a statute that expressly |
|---|
| 22 | 22 | | provides that the requirement of Subsection (a) does not apply to |
|---|
| 23 | 23 | | the election; or |
|---|
| 24 | 24 | | [(7)] the initial election of the members of the |
|---|
| 25 | 25 | | governing body of a newly incorporated city. |

| 26 | 26 | | (c) Except for an election under Subsection (a) or Section |
|---|
| 27 | 27 | | 41.0011 or 41.005(a-1), or a runoff election following an election |
|---|
| 28 | 28 | | held under Subsection (a)(2) or Section 41.005(a-1), an election |
|---|
| 29 | 29 | | may not be held within 30 days before or after the date of the |
|---|
| 30 | 30 | | general election for state and county officers, general primary |
|---|
| 31 | 31 | | election, or runoff primary election. |
|---|
| 32 | 32 | | SECTION 2. Section 41.005, Election Code, is amended by |
|---|
| 33 | 33 | | adding Subsection (a-1) to read as follows: |
|---|
| 34 | 34 | | (a-1) In addition to the election dates prescribed by |
|---|
| 35 | 35 | | Section 41.001, a general election held by a political subdivision |
|---|
| 36 | 36 | | other than a county may be held on the first Tuesday in March. |
|---|
| 37 | 37 | | SECTION 3. This Act takes effect September 1, 2017. |
