| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Subchapter C, Chapter 22, Education Code, is | |
| 12 | 12 | amended by adding Section 22.0841 to read as follows: | |
| 13 | 13 | Sec. 22.0841. CHILD ABUSE AND NEGLECT CENTRAL REGISTRY | |
| 14 | 14 | INFORMATION CHECK. An entity that is required under this | |
| 15 | 15 | subchapter to obtain criminal history record information for any | |
| 16 | 16 | person who has or will have direct contact with students must also | |
| 17 | 17 | submit the person's name to be checked against the central registry | |
| 18 | 18 | of persons found to have abused or neglected a child maintained by | |
| 19 | 19 | the Department of Family and Protective Services under Section | |
| 20 | 20 | 261.002, Family Code. The entity shall consider any information | |
| 21 | 21 | received from the central registry in making a licensing or | |
| 22 | 22 | employment decision regarding the person. | |
| 23 | 23 | SECTION 2. Section 261.002, Family Code, is amended by | |
| 24 | 24 | adding Subsection (g) to read as follows: | |
| 25 | 25 | (g) The department shall provide access to information in | |
| 26 | 26 | the registry for the purpose of a review conducted under Section | |
| 27 | 27 | 22.0841, Education Code. | |
| 28 | 28 | SECTION 3. This Act takes effect September 1, 2017. |
