A BILL TO BE ENTITLED
AN ACT
relating to obtaining information from the child abuse and neglect
central registry regarding certain individuals who have or will
have direct contact with public school students.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter C, Chapter 22, Education Code, is
amended by adding Section 22.0841 to read as follows:
Sec. 22.0841. CHILD ABUSE AND NEGLECT CENTRAL REGISTRY
INFORMATION CHECK. An entity that is required under this
subchapter to obtain criminal history record information for any
person who has or will have direct contact with students must also
submit the person's name to be checked against the central registry
of persons found to have abused or neglected a child maintained by
the Department of Family and Protective Services under Section
261.002, Family Code. The entity shall consider any information
received from the central registry in making a licensing or
employment decision regarding the person.
SECTION 2. Section 261.002, Family Code, is amended by
adding Subsection (g) to read as follows:
(g) The department shall provide access to information in
the registry for the purpose of a review conducted under Section
22.0841, Education Code.
SECTION 3. This Act takes effect September 1, 2017.
