| 13 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 8 | | SECTION 1. Section 407.045, Labor Code, is amended by |
|---|
| 15 | 9 | | adding Subsection (a-1) to read as follows: |
|---|
| 16 | 10 | | (a-1) For purposes of Subsection (a), an adequate program |
|---|
| 17 | 11 | | includes a program in which the certified self-insurer has insured |
|---|
| 18 | 12 | | or reinsured all workers' compensation obligations incurred by the |
|---|
| 19 | 13 | | self-insurer with an authorized insurer under an agreement that is |
|---|
| 20 | 14 | | filed with and approved in writing by the commissioner. The |
|---|
| 21 | 15 | | obligations incurred include: |
|---|
| 22 | 16 | | (1) all known claims and expenses associated with |
|---|
| 23 | 17 | | those claims; and |
|---|
| 24 | 18 | | (2) all incurred but not reported claims and expenses |
|---|
| 25 | 19 | | associated with those claims. |

| 26 | 20 | | SECTION 2. This Act takes effect September 1, 2017. |
