104 AN ACT
115 relating to the requirements for withdrawal by a certified
126 self-insurer from workers' compensation self-insurance.
137 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
148 SECTION 1. Section 407.045, Labor Code, is amended by
159 adding Subsection (a-1) to read as follows:
1610 (a-1) For purposes of Subsection (a), an adequate program
1711 includes a program in which the certified self-insurer has insured
1812 or reinsured all workers' compensation obligations incurred by the
1913 self-insurer with an authorized insurer under an agreement that is
2014 filed with and approved in writing by the commissioner. The
2115 obligations incurred include:
2216 (1) all known claims and expenses associated with
2317 those claims; and
2418 (2) all incurred but not reported claims and expenses
2519 associated with those claims.
2620 SECTION 2. This Act takes effect September 1, 2017.
