| 12 | 6 | | dentists and dental hygienists who provide voluntary charity dental |
|---|
| 13 | 7 | | or dental hygiene care. |

| 14 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 15 | 9 | | SECTION 1. Subchapter C, Chapter 256, Occupations Code, is |
|---|
| 16 | 10 | | amended by adding Section 256.1017 to read as follows: |
|---|
| 17 | 11 | | Sec. 256.1017. MILITARY LIMITED VOLUNTEER LICENSE. (a) |
|---|
| 18 | 12 | | The board shall adopt rules relating to the issuance of a military |
|---|
| 19 | 13 | | limited volunteer license under this section. |
|---|
| 20 | 14 | | (b) The board may issue a military limited volunteer license |
|---|
| 21 | 15 | | to practice dentistry to a dentist or a military limited volunteer |
|---|
| 22 | 16 | | license to practice dental hygiene to a dental hygienist who: |
|---|
| 23 | 17 | | (1) is licensed and in good standing, or was licensed |
|---|
| 24 | 18 | | and retired in good standing, as a dentist or dental hygienist in |
|---|
| 25 | 19 | | another state; |
|---|
| 26 | 20 | | (2) is or was authorized as a dentist or dental |
|---|
| 27 | 21 | | hygienist to treat personnel enlisted in a branch of the United |
|---|
| 28 | 22 | | States armed forces or veterans; and |
|---|
| 29 | 23 | | (3) meets any other requirement prescribed by board |
|---|
| 30 | 24 | | rule. |
|---|
| 31 | 25 | | (c) The board may not issue a license under this section to |
|---|
| 32 | 26 | | an applicant who: |
|---|
| 33 | 27 | | (1) holds a dental or dental hygienist license that: |
|---|
| 34 | 28 | | (A) is currently under active investigation; or |
|---|
| 35 | 29 | | (B) is or was subject to a disciplinary order or |
|---|
| 36 | 30 | | action or to denial by another jurisdiction; |
|---|
| 37 | 31 | | (2) holds a license to prescribe, dispense, |
|---|
| 38 | 32 | | administer, supply, or sell a controlled substance that: |
|---|
| 39 | 33 | | (A) is currently under active investigation; or |
|---|
| 40 | 34 | | (B) is or was subject to a disciplinary order or |
|---|
| 41 | 35 | | action or to denial by another jurisdiction; or |
|---|
| 42 | 36 | | (3) has been convicted of, is on deferred adjudication |
|---|
| 43 | 37 | | community supervision or deferred disposition for, or is under |
|---|
| 44 | 38 | | active investigation for the commission of: |
|---|
| 45 | 39 | | (A) a felony; or |
|---|
| 46 | 40 | | (B) a misdemeanor involving moral turpitude. |
|---|
| 47 | 41 | | (d) A dentist or dental hygienist may practice dentistry or |
|---|
| 48 | 42 | | dental hygiene under a license issued under this section only at a |
|---|
| 49 | 43 | | clinic that primarily treats indigent patients. The dentist or |
|---|
| 50 | 44 | | dental hygienist may not receive compensation for dental or dental |
|---|
| 51 | 45 | | hygiene services rendered at the clinic. |
|---|
| 52 | 46 | | (e) A military limited volunteer license holder is subject |
|---|
| 53 | 47 | | to board rules, including rules regarding disciplinary action, |
|---|
| 54 | 48 | | license registration and renewal, and continuing education. |
|---|
| 55 | 49 | | SECTION 2. This Act takes effect September 1, 2017. |
