66 AN ACT
77 relating to the creation of an offense prohibiting advertisements
88 on an Internet website of certain prostitution offenses.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 43, Penal Code, is amended
1111 by adding Section 43.07 to read as follows:
1212 Sec. 43.07. ADVERTISEMENT OF PROSTITUTION. (a) A person
1313 commits an offense if on an Internet website that is owned or
1414 operated by the person the person publishes or distributes an
1515 advertisement that contains an offer to engage in sexual conduct in
1616 return for receipt of a fee, knowing that the conduct is to be
1717 provided or performed by a victim of an offense under Chapter 20A.
1818 (b) An offense under this section is a state jail felony,
1919 unless it is shown on the trial of the offense that the defendant
2020 has been previously convicted of an offense under this section, in
2121 which event the offense is a felony of the third degree.
2222 SECTION 2. This Act takes effect September 1, 2017.
