| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 43, Penal Code, is amended |
|---|
| 11 | 11 | | by adding Section 43.07 to read as follows: |
|---|
| 12 | 12 | | Sec. 43.07. ADVERTISEMENT OF PROSTITUTION. (a) A person |
|---|
| 13 | 13 | | commits an offense if on an Internet website that is owned or |
|---|
| 14 | 14 | | operated by the person the person publishes or distributes an |
|---|
| 15 | 15 | | advertisement that contains an offer to engage in sexual conduct in |
|---|
| 16 | 16 | | return for receipt of a fee, knowing that the conduct is to be |
|---|
| 17 | 17 | | provided or performed by a victim of an offense under Chapter 20A. |
|---|
| 18 | 18 | | (b) An offense under this section is a state jail felony, |
|---|
| 19 | 19 | | unless it is shown on the trial of the offense that the defendant |
|---|
| 20 | 20 | | has been previously convicted of an offense under this section, in |
|---|
| 21 | 21 | | which event the offense is a felony of the third degree. |
|---|
| 22 | 22 | | SECTION 2. This Act takes effect September 1, 2017. |
