88 AN ACT
99 relating to the confidentiality of certain employment records
1010 submitted to the Texas Commission on Law Enforcement or maintained
1111 by a law enforcement agency.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 1701.454(a), Occupations Code, is
1414 amended to read as follows:
1515 (a) All information submitted to the commission under this
1616 subchapter, including a copy of that information retained by the
1717 submitting law enforcement agency, is confidential and is not
1818 subject to disclosure under Chapter 552, Government Code, unless
1919 the person resigned or was terminated due to substantiated
2020 incidents of excessive force or violations of the law other than
2121 traffic offenses.
2222 SECTION 2. This Act takes effect immediately if it receives
2323 a vote of two-thirds of all the members elected to each house, as
2424 provided by Section 39, Article III, Texas Constitution. If this
2525 Act does not receive the vote necessary for immediate effect, this
2626 Act takes effect September 1, 2017.
