| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 1701.454(a), Occupations Code, is |
|---|
| 14 | 14 | | amended to read as follows: |
|---|
| 15 | 15 | | (a) All information submitted to the commission under this |
|---|
| 16 | 16 | | subchapter, including a copy of that information retained by the |
|---|
| 17 | 17 | | submitting law enforcement agency, is confidential and is not |
|---|
| 18 | 18 | | subject to disclosure under Chapter 552, Government Code, unless |
|---|
| 19 | 19 | | the person resigned or was terminated due to substantiated |
|---|
| 20 | 20 | | incidents of excessive force or violations of the law other than |
|---|
| 21 | 21 | | traffic offenses. |

| 22 | 22 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 23 | 23 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 24 | 24 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 25 | 25 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 26 | 26 | | Act takes effect September 1, 2017. |
