| 12 | 6 | | ombudsman of the Office of Injured Employee Counsel under the Texas |

| 14 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 15 | 9 | | SECTION 1. Section 404.152(b), Labor Code, is amended to |
|---|
| 16 | 10 | | read as follows: |
|---|
| 17 | 11 | | (b) To be eligible for designation as an ombudsman, a person |
|---|
| 18 | 12 | | must: |
|---|
| 19 | 13 | | (1) demonstrate satisfactory knowledge of the |
|---|
| 20 | 14 | | requirements of: |
|---|
| 21 | 15 | | (A) this subtitle and the provisions of Subtitle |
|---|
| 22 | 16 | | C that relate to claims management; |
|---|
| 23 | 17 | | (B) other laws relating to workers' |
|---|
| 24 | 18 | | compensation; and |
|---|
| 25 | 19 | | (C) rules adopted under this subtitle and the |
|---|
| 26 | 20 | | laws described under Subdivision (1)(B); |
|---|
| 27 | 21 | | (2) have demonstrated experience in handling and |
|---|
| 28 | 22 | | resolving problems for the general public; and |
|---|
| 29 | 23 | | (3) possess strong interpersonal skills[; and |
|---|
| 30 | 24 | | [(4) have at least one year of demonstrated experience |
|---|
| 31 | 25 | | in the field of workers' compensation]. |
|---|
| 32 | 26 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 33 | 27 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 34 | 28 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 35 | 29 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 36 | 30 | | Act takes effect September 1, 2017. |
