| 13 | 5 | | relating to quorum and voting requirements for the transaction of |

| 14 | 6 | | business by the board of the Irving Flood Control District Section |

| 16 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 17 | 9 | | SECTION 1. Subchapter B, Chapter 7805, Special District |
|---|
| 18 | 10 | | Local Laws Code, is amended by adding Section 7805.054 to read as |
|---|
| 19 | 11 | | follows: |
|---|
| 20 | 12 | | Sec. 7805.054. QUORUM; VOTE REQUIRED. A quorum consists of |
|---|
| 21 | 13 | | three directors. An action or recommendation of the board |
|---|
| 22 | 14 | | requiring a vote of the board is not valid unless: |
|---|
| 23 | 15 | | (1) the action or recommendation is approved by a |
|---|
| 24 | 16 | | record vote taken at a meeting of the board with a quorum present; |
|---|
| 25 | 17 | | and |
|---|
| 26 | 18 | | (2) the action or recommendation receives at least |
|---|
| 27 | 19 | | three affirmative votes by board members. |
|---|
| 28 | 20 | | SECTION 2. (a) All governmental and proprietary actions |
|---|
| 29 | 21 | | and proceedings of the Irving Flood Control District Section III of |
|---|
| 30 | 22 | | Dallas County taken before the effective date of this Act are |
|---|
| 31 | 23 | | validated, ratified, and confirmed in all respects as of the dates |
|---|
| 32 | 24 | | on which they occurred. |
|---|
| 33 | 25 | | (b) This section does not apply to any matter that on the |
|---|
| 34 | 26 | | effective date of this Act: |
|---|
| 35 | 27 | | (1) is involved in litigation if the litigation |
|---|
| 36 | 28 | | ultimately results in the matter being held invalid by a final court |
|---|
| 37 | 29 | | judgment; or |
|---|
| 38 | 30 | | (2) has been held invalid by a final court judgment. |
|---|
| 39 | 31 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 40 | 32 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 41 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 42 | 34 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 43 | 35 | | Act takes effect September 1, 2017. |
