| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Chapter 39, Education Code, is amended by adding |
|---|
| 12 | 12 | | Subchapter A to read as follows: |
|---|
| 13 | 13 | | SUBCHAPTER A. GENERAL PROVISIONS |
|---|
| 14 | 14 | | Sec. 39.001. STUDY AND REPORT CONCERNING CONSIDERATION OF |
|---|
| 15 | 15 | | PERFORMANCE OF GIFTED AND TALENTED STUDENTS UNDER PUBLIC SCHOOL |
|---|
| 16 | 16 | | ACCOUNTABILITY SYSTEM. (a) The commissioner shall study and |
|---|
| 17 | 17 | | determine the most appropriate method for including the performance |
|---|
| 18 | 18 | | of gifted and talented students served in a program established |
|---|
| 19 | 19 | | under Subchapter D, Chapter 29, in determining the performance of a |
|---|
| 20 | 20 | | school district or campus for purposes of accountability under this |
|---|
| 21 | 21 | | chapter. |
|---|
| 22 | 22 | | (b) Based on the study under Subsection (a), not later than |
|---|
| 23 | 23 | | December 1, 2018, the commissioner shall submit a report to the |
|---|
| 24 | 24 | | governor, the lieutenant governor, the speaker of the house of |
|---|
| 25 | 25 | | representatives, and the presiding officers of the standing |
|---|
| 26 | 26 | | committees in the senate and house primarily responsible for public |
|---|
| 27 | 27 | | education. The commissioner must include in the report the |
|---|
| 28 | 28 | | commissioner's recommended method determined under Subsection (a) |
|---|
| 29 | 29 | | and any proposed legislation needed to implement that |
|---|
| 30 | 30 | | recommendation. |
|---|
| 31 | 31 | | Sec. 39.002. EXPIRATION. This subchapter expires December |
|---|
| 32 | 32 | | 31, 2018. |
|---|
| 33 | 33 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 34 | 34 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 35 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 36 | 36 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 37 | 37 | | Act takes effect September 1, 2017. |
