| 13 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 8 | | SECTION 1. Section 1301.359(b), Occupations Code, is |
|---|
| 15 | 9 | | amended to read as follows: |
|---|
| 16 | 10 | | (b) Except as provided by Section 1301.406, the number of a |
|---|
| 17 | 11 | | license, endorsement, or registration issued under this chapter is |
|---|
| 18 | 12 | | not assignable or transferable. |
|---|
| 19 | 13 | | SECTION 2. Section 1301.406, Occupations Code, is amended |
|---|
| 20 | 14 | | to read as follows: |
|---|
| 21 | 15 | | Sec. 1301.406. TRANSFER OF LICENSE NUMBER. (a) On approval |
|---|
| 22 | 16 | | by the board, a person who holds an unexpired license under this |
|---|
| 23 | 17 | | chapter and whose license has been held continuously for at least 35 |
|---|
| 24 | 18 | | [50] consecutive years may transfer the license number on the date |
|---|
| 25 | 19 | | of the person's retirement or death to another person who: |
|---|
| 26 | 20 | | (1) is related within the second degree by |
|---|
| 27 | 21 | | consanguinity to the transferor; and |
|---|
| 28 | 22 | | (2) holds a license issued [as a journeyman plumber or |
|---|
| 29 | 23 | | master plumber] under this chapter that is the same type of license |
|---|
| 30 | 24 | | as the license held by the transferor. |
|---|
| 31 | 25 | | (b) The application for a [license] transfer of a license |
|---|
| 32 | 26 | | number under this section must include the transferor's consent and |
|---|
| 33 | 27 | | a designation of whether the license number will transfer on the |
|---|
| 34 | 28 | | retirement or death of the transferor. |
|---|
| 35 | 29 | | (c) The board shall transfer a license number to a person |
|---|
| 36 | 30 | | who submits an application and presents evidence satisfactory to |
|---|
| 37 | 31 | | the board that: |
|---|
| 38 | 32 | | (1) the person meets the requirements under |
|---|
| 39 | 33 | | Subsections (a)(1) and (a)(2); and |
|---|
| 40 | 34 | | (2) the transferor is retired or dead. |
|---|
| 41 | 35 | | SECTION 3. As soon as practicable after the effective date |
|---|
| 42 | 36 | | of this Act, the Texas State Board of Plumbing Examiners shall adopt |
|---|
| 43 | 37 | | rules necessary to implement Section 1301.406, Occupations Code, as |
|---|
| 44 | 38 | | amended by this Act. |
|---|
| 45 | 39 | | SECTION 4. Not later than January 1, 2018, the Texas State |
|---|
| 46 | 40 | | Board of Plumbing Examiners shall begin accepting applications for |
|---|
| 47 | 41 | | the transfer of license numbers under Section 1301.406, Occupations |
|---|
| 48 | 42 | | Code, as amended by this Act. |
|---|
| 49 | 43 | | SECTION 5. This Act takes effect September 1, 2017. |
