| 13 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 8 | | SECTION 1. Section 74.08(a), Alcoholic Beverage Code, is |
|---|
| 15 | 9 | | amended to read as follows: |
|---|
| 16 | 10 | | (a) In addition to the activities authorized by Section |
|---|
| 17 | 11 | | 74.01, the holder of a brewpub license who holds a wine and beer |
|---|
| 18 | 12 | | retailer's permit and whose sale of beer, ale, or malt liquor |
|---|
| 19 | 13 | | consists only of beer, ale, or malt liquor [who sells alcoholic |
|---|
| 20 | 14 | | beverages] manufactured [only] on the brewpub's premises may: |
|---|
| 21 | 15 | | (1) sell malt liquor or ale produced under the license |
|---|
| 22 | 16 | | to those retailers or qualified persons to whom the holder of a |
|---|
| 23 | 17 | | general class B wholesaler's permit may sell malt liquor or ale |
|---|
| 24 | 18 | | under Section 20.01; and |
|---|
| 25 | 19 | | (2) sell beer produced under the license to: |
|---|
| 26 | 20 | | (A) those retailers to whom the holder of a |
|---|
| 27 | 21 | | general distributor's license may sell beer under Section 64.01; or |
|---|
| 28 | 22 | | (B) qualified persons to whom the holder of a |
|---|
| 29 | 23 | | general distributor's license may sell beer for shipment and |
|---|
| 30 | 24 | | consumption outside the state under Section 64.01. |
|---|
| 31 | 25 | | SECTION 2. This Act takes effect September 1, 2017. |
