| 13 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 8 | | SECTION 1. Section 408.183(b-1), Labor Code, is amended to |
|---|
| 15 | 9 | | read as follows: |
|---|
| 16 | 10 | | (b-1) Notwithstanding Subsection (b), an eligible spouse |
|---|
| 17 | 11 | | who remarried is eligible for death benefits for life if the |
|---|
| 18 | 12 | | employee was a first responder, as defined by Section 504.055, who |
|---|
| 19 | 13 | | suffered death in the course and scope of employment or while |
|---|
| 20 | 14 | | providing services as a volunteer. This subsection applies |
|---|
| 21 | 15 | | regardless of the date on which the death of the first responder |
|---|
| 22 | 16 | | occurred. |
|---|
| 23 | 17 | | SECTION 2. Section 2, Chapter 1018 (H.B. 1094), Acts of the |
|---|
| 24 | 18 | | 84th Legislature, Regular Session, 2015, is repealed. |
|---|
| 25 | 19 | | SECTION 3. The change in law made by this Act to Section |
|---|
| 26 | 20 | | 408.183, Labor Code, applies only to an eligible spouse who |
|---|
| 27 | 21 | | remarries on or after the effective date of this Act. An eligible |
|---|
| 28 | 22 | | spouse who remarried before that date is governed by the law as it |
|---|
| 29 | 23 | | existed immediately before the effective date of this Act, and the |
|---|
| 30 | 24 | | former law is continued in effect for that purpose. |

| 31 | 25 | | SECTION 4. This Act takes effect September 1, 2017. |
