13 | 6 | | federal agencies about certain child abuse and neglect |

15 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

16 | 9 | | SECTION 1. Section 261.301, Family Code, is amended by |
---|
17 | 10 | | adding Subsection (j) to read as follows: |
---|
18 | 11 | | (j) In an investigation of a report of abuse or neglect |
---|
19 | 12 | | allegedly committed by a person responsible for a child's care, |
---|
20 | 13 | | custody, or welfare, the department shall determine whether the |
---|
21 | 14 | | person is an active duty member of the United States armed forces or |
---|
22 | 15 | | the spouse of a member on active duty. If the department determines |
---|
23 | 16 | | the person is an active duty member of the United States armed |
---|
24 | 17 | | forces or the spouse of a member on active duty, the department |
---|
25 | 18 | | shall notify the United States Department of Defense Family |
---|
26 | 19 | | Advocacy Program at the closest active duty military installation |
---|
27 | 20 | | of the investigation. |
---|
28 | 21 | | SECTION 2. The changes in law made by this Act to Section |
---|
29 | 22 | | 261.301, Family Code, apply only to a report of abuse or neglect |
---|
30 | 23 | | made on or after the effective date of this Act. A report made |
---|
31 | 24 | | before that date is governed by the law in effect on the date the |
---|
32 | 25 | | report was made, and the former law is continued in effect for that |
---|
33 | 26 | | purpose. |

34 | 27 | | SECTION 3. This Act takes effect September 1, 2017. |
