125 relating to the procedures for identifying and notifying relevant
136 federal agencies about certain child abuse and neglect
147 investigations.
158 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
169 SECTION 1. Section 261.301, Family Code, is amended by
1710 adding Subsection (j) to read as follows:
1811 (j) In an investigation of a report of abuse or neglect
1912 allegedly committed by a person responsible for a child's care,
2013 custody, or welfare, the department shall determine whether the
2114 person is an active duty member of the United States armed forces or
2215 the spouse of a member on active duty. If the department determines
2316 the person is an active duty member of the United States armed
2417 forces or the spouse of a member on active duty, the department
2518 shall notify the United States Department of Defense Family
2619 Advocacy Program at the closest active duty military installation
2720 of the investigation.
2821 SECTION 2. The changes in law made by this Act to Section
2922 261.301, Family Code, apply only to a report of abuse or neglect
3023 made on or after the effective date of this Act. A report made
3124 before that date is governed by the law in effect on the date the
3225 report was made, and the former law is continued in effect for that
3326 purpose.
3427 SECTION 3. This Act takes effect September 1, 2017.
