|---|
| 9 | 9 | | for public schools. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter B, Chapter 31, Education Code, is |
|---|
| 12 | 12 | | amended by adding Section 31.036 to read as follows: |
|---|
| 13 | 13 | | Sec. 31.036. ACCESS TO PRINTED INSTRUCTIONAL MATERIALS IN |
|---|
| 14 | 14 | | ELECTRONIC FORMAT. (a) This section applies only to instructional |
|---|
| 15 | 15 | | materials or supplemental instructional materials provided in |
|---|
| 16 | 16 | | printed book format. |
|---|
| 17 | 17 | | (b) The publisher of instructional materials or |
|---|
| 18 | 18 | | supplemental instructional materials subject to this section |
|---|
| 19 | 19 | | purchased as provided by this chapter for a school district shall |
|---|
| 20 | 20 | | provide the district at no additional cost with access to the |
|---|
| 21 | 21 | | materials in an electronic format as provided by this section. |
|---|
| 22 | 22 | | (c) Instructional materials or supplemental instructional |
|---|
| 23 | 23 | | materials may be accessed in an electronic format under this |
|---|
| 24 | 24 | | section only for educational purposes by: |
|---|
| 25 | 25 | | (1) students enrolled in a course or subject for which |
|---|
| 26 | 26 | | the materials were purchased for the purpose of completing that |
|---|
| 27 | 27 | | course or subject and only for the period during which the student |
|---|
| 28 | 28 | | is enrolled; |
|---|
| 29 | 29 | | (2) teachers providing instruction in a course or |
|---|
| 30 | 30 | | subject for which the materials were purchased for the purpose of |
|---|
| 31 | 31 | | providing that instruction and only for the period during which the |
|---|
| 32 | 32 | | materials in printed book format are assigned for that course or |
|---|
| 33 | 33 | | subject; and |
|---|
| 34 | 34 | | (3) school and district administrators for a district |
|---|
| 35 | 35 | | campus at which a course or subject for which the materials were |
|---|
| 36 | 36 | | purchased is provided and only for the period during which the |
|---|
| 37 | 37 | | materials in printed book format are assigned for that course or |
|---|
| 38 | 38 | | subject. |
|---|
| 39 | 39 | | (d) The commissioner shall adopt rules to administer this |
|---|
| 40 | 40 | | section. |
|---|
| 41 | 41 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 42 | 42 | | to instructional materials or supplemental instructional materials |
|---|
| 43 | 43 | | purchased under a contract entered into on or after the effective |
|---|
| 44 | 44 | | date of this Act. Instructional materials or supplemental |
|---|
| 45 | 45 | | instructional materials purchased under a contract entered into |
|---|
| 46 | 46 | | before the effective date of this Act are governed by the law in |
|---|
| 47 | 47 | | effect on the date the contract was entered into, and the former law |
|---|
| 48 | 48 | | is continued in effect for that purpose. |
|---|
| 49 | 49 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 50 | 50 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 51 | 51 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 52 | 52 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 53 | 53 | | Act takes effect September 1, 2017. |
