55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to requirements regarding electronic access to
88 instructional materials provided in printed book format purchased
99 for public schools.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 31, Education Code, is
1212 amended by adding Section 31.036 to read as follows:
1313 Sec. 31.036. ACCESS TO PRINTED INSTRUCTIONAL MATERIALS IN
1414 ELECTRONIC FORMAT. (a) This section applies only to instructional
1515 materials or supplemental instructional materials provided in
1616 printed book format.
1717 (b) The publisher of instructional materials or
1818 supplemental instructional materials subject to this section
1919 purchased as provided by this chapter for a school district shall
2020 provide the district at no additional cost with access to the
2121 materials in an electronic format as provided by this section.
2222 (c) Instructional materials or supplemental instructional
2323 materials may be accessed in an electronic format under this
2424 section only for educational purposes by:
2525 (1) students enrolled in a course or subject for which
2626 the materials were purchased for the purpose of completing that
2727 course or subject and only for the period during which the student
2828 is enrolled;
2929 (2) teachers providing instruction in a course or
3030 subject for which the materials were purchased for the purpose of
3131 providing that instruction and only for the period during which the
3232 materials in printed book format are assigned for that course or
3333 subject; and
3434 (3) school and district administrators for a district
3535 campus at which a course or subject for which the materials were
3636 purchased is provided and only for the period during which the
3737 materials in printed book format are assigned for that course or
3838 subject.
3939 (d) The commissioner shall adopt rules to administer this
4040 section.
4141 SECTION 2. The change in law made by this Act applies only
4242 to instructional materials or supplemental instructional materials
4343 purchased under a contract entered into on or after the effective
4444 date of this Act. Instructional materials or supplemental
4545 instructional materials purchased under a contract entered into
4646 before the effective date of this Act are governed by the law in
4747 effect on the date the contract was entered into, and the former law
4848 is continued in effect for that purpose.
4949 SECTION 3. This Act takes effect immediately if it receives
5050 a vote of two-thirds of all the members elected to each house, as
5151 provided by Section 39, Article III, Texas Constitution. If this
5252 Act does not receive the vote necessary for immediate effect, this
5353 Act takes effect September 1, 2017.
