No. 213 A BILL TO BE ENTITLED AN ACT relating to requirements regarding electronic access to instructional materials provided in printed book format purchased for public schools. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter B, Chapter 31, Education Code, is amended by adding Section 31.036 to read as follows: Sec. 31.036. ACCESS TO PRINTED INSTRUCTIONAL MATERIALS IN ELECTRONIC FORMAT. (a) This section applies only to instructional materials or supplemental instructional materials provided in printed book format. (b) The publisher of instructional materials or supplemental instructional materials subject to this section purchased as provided by this chapter for a school district shall provide the district at no additional cost with access to the materials in an electronic format as provided by this section. (c) Instructional materials or supplemental instructional materials may be accessed in an electronic format under this section only for educational purposes by: (1) students enrolled in a course or subject for which the materials were purchased for the purpose of completing that course or subject and only for the period during which the student is enrolled; (2) teachers providing instruction in a course or subject for which the materials were purchased for the purpose of providing that instruction and only for the period during which the materials in printed book format are assigned for that course or subject; and (3) school and district administrators for a district campus at which a course or subject for which the materials were purchased is provided and only for the period during which the materials in printed book format are assigned for that course or subject. (d) The commissioner shall adopt rules to administer this section. SECTION 2. The change in law made by this Act applies only to instructional materials or supplemental instructional materials purchased under a contract entered into on or after the effective date of this Act. Instructional materials or supplemental instructional materials purchased under a contract entered into before the effective date of this Act are governed by the law in effect on the date the contract was entered into, and the former law is continued in effect for that purpose. SECTION 3. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2017.
