| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 772.006, Government Code, is amended by | |
| 11 | 11 | adding Subsection (g) to read as follows: | |
| 12 | 12 | (g) The criminal justice division may not award a grant to | |
| 13 | 13 | the Department of Public Safety, the Texas Department of Criminal | |
| 14 | 14 | Justice, a police department of a municipality with a population of | |
| 15 | 15 | 800,000 or more, or a sheriff's department of a county with a | |
| 16 | 16 | population of one million or more unless the department is a party | |
| 17 | 17 | to an agreement with the United States Secretary of Homeland | |
| 18 | 18 | Security and United States Immigration and Customs Enforcement | |
| 19 | 19 | under Section 287(g), Immigration and Nationality Act (8 U.S.C. | |
| 20 | 20 | Section 1357). | |
| 21 | 21 | SECTION 2. The change in law made by this Act applies only | |
| 22 | 22 | to a grant application submitted to the criminal justice division | |
| 23 | 23 | of the governor's office on or after the effective date of this Act. | |
| 24 | 24 | A grant application submitted before the effective date of this Act | |
| 25 | 25 | is governed by the law in effect on the date the application was | |
| 26 | 26 | submitted, and that law is continued in effect for that purpose. | |
| 27 | 27 | SECTION 3. This Act takes effect September 1, 2017. |
