12	4		AN ACT
13	5		relating to the board of trustees of the Weatherford Junior College
14	6		District.
15	7		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
16	8		SECTION 1. Subchapter E, Chapter 130, Education Code, is
17	9		amended by adding Section 130.0828 to read as follows:
18	10		Sec. 130.0828. ADDITIONAL TRUSTEES FOR WEATHERFORD JUNIOR
19	11		COLLEGE DISTRICT. (a) Notwithstanding any other law, in addition
20	12		to the members of the board of trustees of the Weatherford Junior
21	13		College District elected or appointed under other provisions of
22	14		this subchapter, the commissioners court of each county in which a
23	15		branch campus of the district is located and that imposed a branch
24	16		campus maintenance tax under Section 130.253 on September 1, 2017,
25	17		shall appoint one member to serve on the district's board of
26	18		trustees.
27	19		(b) Members of the board of trustees appointed under this
28	20		section serve two-year terms and may be appointed to serve
29	21		successive terms. The commissioners court shall appoint initial
30	22		members to serve a term beginning December 1, 2017.
31	23		(c) Except as provided by Subsection (d), a member of the
32	24		board of trustees appointed under this section may participate in
33	25		the decision-making of the board to the same extent as any other
34	26		member of the board, including by voting on any budget that affects
35	27		the entire district.
36	28		(d) A member of the board of trustees appointed under this
37	29		section:
38	30		(1) may not participate in the decision-making of the
39	31		board in matters related to:
40	32		(A) the imposition of a tax; or
41	33		(B) an issue that only affects a campus located
42	34		in the junior college district;
43	35		(2) is not counted for purposes of determining whether
44	36		a quorum of the board is present for the purpose of Subdivision (1);
45	37		and
46	38		(3) may not serve as an officer of the board of
47	39		trustees.
48	40		(e) Unless this section is continued in effect by the
49	41		legislature, this section expires on December 1, 2027.
50	42		SECTION 2. The commissioners court of each county to which
51	43		Section 130.0828, Education Code, as added by this Act, applies
52	44		shall appoint the initial members of the board of trustees of the
53	45		Weatherford Junior College District under that section not later
54	46		than November 30, 2017.
55	47		SECTION 3. SEVERABILITY. (a) It is the intent of the
56	48		legislature that every provision, section, subsection, sentence,
57	49		clause, phrase, and word in this Act, and every application of the
58	50		provisions in this Act to each local law, are severable from each
59	51		other. All constitutionally valid and lawful applications of this
60	52		Act shall be severed from an application that a court finds to be
61	53		invalid, leaving the valid applications in force because it is the
62	54		legislature's intent and priority that the valid applications be
63	55		allowed to stand alone.
64	56		(b) A court may not decline to enforce the severability
65	57		requirements in this Act on the ground that the enforcement of the
66	58		severability requirements would be contrary to legislative intent.
67	59		The legislature hereby declares that it intends for the
68	60		severability requirements of this Act to be enforced as written,
69	61		without any exceptions.
70	62		(c) A court may not decline to enforce the severability
71	63		requirements of this Act on the ground that the Act's provisions or
72	64		applications are essentially and inseparably connected. The
73	65		legislature hereby declares that it intends for the severability
74	66		requirements of this Act to be enforced without regard to whether
75	67		this Act's provisions or applications are essentially and
76	68		inseparably connected.
77	69		(d) If a final court order or judgment finds that the
78	70		composition of the board of trustees of the Weatherford Junior
79	71		College District as composed under this Act is invalid, the
80	72		court-ordered remedy shall require the appointment of members of
81	73		the board of trustees by the commissioners court of each county in
82	74		which a branch campus of the district is located in the manner
83	75		described by Section 130.0828, Education Code, as added by this
84	76		Act, so that the composition of the board of trustees complies with
85	77		applicable law.
86	78		(e) Section 311.032(a), Government Code, applies to this
87	79		Act.
88	80		SECTION 4. This Act takes effect September 1, 2017.
