| 12 | 5 | | relating to volunteer firefighter supervision of outdoor burning of |

| 14 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 15 | 8 | | SECTION 1. Section 382.018(d), Health and Safety Code, is |
|---|
| 16 | 9 | | amended to read as follows: |
|---|
| 17 | 10 | | (d) The commission may not control or prohibit outdoor |
|---|
| 18 | 11 | | burning of waste consisting of trees, brush, grass, leaves, branch |
|---|
| 19 | 12 | | trimmings, or other plant growth if: |
|---|
| 20 | 13 | | (1) the person burning the waste is doing so at a site: |
|---|
| 21 | 14 | | (A) designated for consolidated burning of waste |
|---|
| 22 | 15 | | generated from specific residential properties; |
|---|
| 23 | 16 | | (B) located in a county with a population of less |
|---|
| 24 | 17 | | than 50,000; |
|---|
| 25 | 18 | | (C) located outside of a municipality; and |
|---|
| 26 | 19 | | (D) supervised at the time of the burning by: |
|---|
| 27 | 20 | | (i) an employee of a fire department who is |
|---|
| 28 | 21 | | part of the fire protection personnel, as defined by Section |
|---|
| 29 | 22 | | 419.021, Government Code, of the department and is acting in the |
|---|
| 30 | 23 | | scope of the person's employment; or |
|---|
| 31 | 24 | | (ii) a volunteer firefighter acting in the |
|---|
| 32 | 25 | | scope of the firefighter's volunteer duties; and |
|---|
| 33 | 26 | | (2) the waste was generated from a property for which |
|---|
| 34 | 27 | | the site is designated. |

| 35 | 28 | | SECTION 2. This Act takes effect September 1, 2017. |
