66 AN ACT
77 relating to standards for mental health services provided to
88 certain individuals with intellectual and developmental
99 disabilities.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 533, Health and Safety
1212 Code, is amended by adding Section 533.054 to read as follows:
1313 Sec. 533.054. STANDARDS FOR MENTAL HEALTH SERVICES PROVIDED
1414 TO RESIDENTS WITH INTELLECTUAL AND DEVELOPMENTAL DISABILITIES. (a)
1515 The executive commissioner, after consultation with the
1616 department, by rule shall develop standards for the adequate
1717 provision of quality mental health services to individuals with
1818 intellectual and developmental disabilities and co-occurring
1919 mental health conditions, including substance use conditions, who
2020 are residing in department facilities.
2121 (b) In developing the standards under Subsection (a), the
2222 executive commissioner shall emphasize the importance of
2323 trauma-informed care and ensure that the mental health services
2424 provided to individuals described by Subsection (a) include
2525 services relating to:
2626 (1) assessment;
2727 (2) evaluation, including evaluation for past trauma;
2828 (3) diagnosis;
2929 (4) treatment; and
3030 (5) recovery.
3131 (c) The executive commissioner, with stakeholder input and
3232 after holding a public hearing, shall review and update the
3333 standards every five years.
3434 SECTION 2. Subchapter B, Chapter 534, Health and Safety
3535 Code, is amended by adding Section 534.0525 to read as follows:
3636 Sec. 534.0525. STANDARDS FOR COMMUNITY-BASED MENTAL HEALTH
3737 SERVICES PROVIDED TO INDIVIDUALS WITH INTELLECTUAL AND
3838 DEVELOPMENTAL DISABILITIES. (a) The executive commissioner, after
3939 consultation with the department, by rule shall develop standards
4040 for the adequate provision of quality community-based mental health
4141 services through a local mental health authority under this
4242 subchapter to individuals with intellectual and developmental
4343 disabilities and co-occurring mental health conditions, including
4444 substance use conditions.
4545 (b) In developing the standards under Subsection (a), the
4646 executive commissioner shall emphasize the importance of
4747 trauma-informed care and ensure that the mental health services
4848 provided to the individuals described by Subsection (a) include the
4949 services required by Section 534.053 and services relating to:
5050 (1) assessment;
5151 (2) evaluation, including evaluation for past trauma;
5252 (3) diagnosis;
5353 (4) treatment; and
5454 (5) recovery.
5555 (c) The executive commissioner, with stakeholder input and
5656 after holding a public hearing, shall review and update the
5757 standards every five years.
5858 SECTION 3. The executive commissioner of the Health and
5959 Human Services Commission shall adopt rules as required by Sections
6060 533.054 and 534.0525, Health and Safety Code, as added by this Act,
6161 as soon as practicable.
6262 SECTION 4. This Act takes effect September 1, 2017.
