6	6	AN ACT
7	7	relating to standards for mental health services provided to
8	8	certain individuals with intellectual and developmental
9	9	disabilities.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. Subchapter B, Chapter 533, Health and Safety
12	12	Code, is amended by adding Section 533.054 to read as follows:
13	13	Sec. 533.054. STANDARDS FOR MENTAL HEALTH SERVICES PROVIDED
14	14	TO RESIDENTS WITH INTELLECTUAL AND DEVELOPMENTAL DISABILITIES. (a)
15	15	The executive commissioner, after consultation with the
16	16	department, by rule shall develop standards for the adequate
17	17	provision of quality mental health services to individuals with
18	18	intellectual and developmental disabilities and co-occurring
19	19	mental health conditions, including substance use conditions, who
20	20	are residing in department facilities.
21	21	(b) In developing the standards under Subsection (a), the
22	22	executive commissioner shall emphasize the importance of
23	23	trauma-informed care and ensure that the mental health services
24	24	provided to individuals described by Subsection (a) include
25	25	services relating to:
26	26	(1) assessment;
27	27	(2) evaluation, including evaluation for past trauma;
28	28	(3) diagnosis;
29	29	(4) treatment; and
30	30	(5) recovery.
31	31	(c) The executive commissioner, with stakeholder input and
32	32	after holding a public hearing, shall review and update the
33	33	standards every five years.
34	34	SECTION 2. Subchapter B, Chapter 534, Health and Safety
35	35	Code, is amended by adding Section 534.0525 to read as follows:
36	36	Sec. 534.0525. STANDARDS FOR COMMUNITY-BASED MENTAL HEALTH
37	37	SERVICES PROVIDED TO INDIVIDUALS WITH INTELLECTUAL AND
38	38	DEVELOPMENTAL DISABILITIES. (a) The executive commissioner, after
39	39	consultation with the department, by rule shall develop standards
40	40	for the adequate provision of quality community-based mental health
41	41	services through a local mental health authority under this
42	42	subchapter to individuals with intellectual and developmental
43	43	disabilities and co-occurring mental health conditions, including
44	44	substance use conditions.
45	45	(b) In developing the standards under Subsection (a), the
46	46	executive commissioner shall emphasize the importance of
47	47	trauma-informed care and ensure that the mental health services
48	48	provided to the individuals described by Subsection (a) include the
49	49	services required by Section 534.053 and services relating to:
50	50	(1) assessment;
51	51	(2) evaluation, including evaluation for past trauma;
52	52	(3) diagnosis;
53	53	(4) treatment; and
54	54	(5) recovery.
55	55	(c) The executive commissioner, with stakeholder input and
56	56	after holding a public hearing, shall review and update the
57	57	standards every five years.
58	58	SECTION 3. The executive commissioner of the Health and
59	59	Human Services Commission shall adopt rules as required by Sections
60	60	533.054 and 534.0525, Health and Safety Code, as added by this Act,
61	61	as soon as practicable.
62	62	SECTION 4. This Act takes effect September 1, 2017.
