85R6274 JG-D By: Price H.B. No. 2415 A BILL TO BE ENTITLED AN ACT relating to standards for mental health services provided to certain individuals with intellectual and developmental disabilities. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter B, Chapter 533, Health and Safety Code, is amended by adding Section 533.054 to read as follows: Sec. 533.054. STANDARDS FOR MENTAL HEALTH SERVICES PROVIDED TO RESIDENTS WITH INTELLECTUAL AND DEVELOPMENTAL DISABILITIES. (a) The executive commissioner, after consultation with the department, by rule shall develop standards for the adequate provision of quality mental health services to individuals with intellectual and developmental disabilities and co-occurring mental health conditions, including substance use conditions, who are residing in department facilities. (b) In developing the standards under Subsection (a), the executive commissioner shall emphasize the importance of trauma-informed care and ensure that the mental health services provided to individuals described by Subsection (a) include services relating to: (1) assessment; (2) evaluation, including evaluation for past trauma; (3) diagnosis; (4) treatment; and (5) recovery. (c) The executive commissioner, with stakeholder input and after holding a public hearing, shall review and update the standards every five years. SECTION 2. Subchapter B, Chapter 534, Health and Safety Code, is amended by adding Section 534.0525 to read as follows: Sec. 534.0525. STANDARDS FOR COMMUNITY-BASED MENTAL HEALTH SERVICES PROVIDED TO INDIVIDUALS WITH INTELLECTUAL AND DEVELOPMENTAL DISABILITIES. (a) The executive commissioner, after consultation with the department, by rule shall develop standards for the adequate provision of quality community-based mental health services through a local mental health authority under this subchapter to individuals with intellectual and developmental disabilities and co-occurring mental health conditions, including substance use conditions. (b) In developing the standards under Subsection (a), the executive commissioner shall emphasize the importance of trauma-informed care and ensure that the mental health services provided to the individuals described by Subsection (a) include the services required by Section 534.053 and services relating to: (1) assessment; (2) evaluation, including evaluation for past trauma; (3) diagnosis; (4) treatment; and (5) recovery. (c) The executive commissioner, with stakeholder input and after holding a public hearing, shall review and update the standards every five years. SECTION 3. The executive commissioner of the Health and Human Services Commission shall adopt rules as required by Sections 533.054 and 534.0525, Health and Safety Code, as added by this Act, as soon as practicable. SECTION 4. This Act takes effect September 1, 2017.
