55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the territory of the Barton Springs-Edwards Aquifer
88 Conservation District.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 8802.003, Special District Local Laws
1111 Code, is amended to read as follows:
1212 Sec. 8802.003. DISTRICT TERRITORY. (a) The district is
1313 composed of:
1414 (1) the territory described by the Texas Water
1515 Commission's August 15, 1986, order, as that territory may have
1616 been modified under:
1717 (A) [(1)] Subchapter J, Chapter 36, Water Code;
1818 or
1919 (B) [(2)] other law; and
2020 (2) the territory described as follows:
2121 Beginning at a point at the intersection of the district
2222 boundary as it existed on January 1, 2017, and IH-35 and East
2323 William Cannon Drive, then running east on East William Cannon
2424 Drive to a point where East William Cannon Drive intersects Bluff
2525 Springs Road, then south and southeasterly along Bluff Springs Road
2626 to a point where Bluff Springs Road intersects the district
2727 boundary as it existed on January 1, 2017, then west and
2828 southwesterly turning northeasterly along the district boundary as
2929 it existed on January 1, 2017, to the place of beginning.
3030 (b) A boundary reference in Subsection (a) to a road,
3131 highway, or drive means the centerline, as of January 1, 2017, of
3232 the road, highway, or drive.
3333 SECTION 2. Section 8802.053, Special District Local Laws
3434 Code, is amended by adding Subsection (f) to read as follows:
3535 (f) If the district is required to create single-member
3636 districts that do not comply with other provisions of this section
3737 in order to satisfy standards under federal law, the board of
3838 directors shall revise the single-member districts as the board
3939 considers appropriate to comply with those federal standards.
4040 SECTION 3. The board of directors of the Barton
4141 Springs-Edwards Aquifer Conservation District shall add the
4242 territory described by Section 8802.003(a)(2), Special District
4343 Local Laws Code, as added by this Act, to single-member district
4444 number four, as that district existed on May 26, 2016.
4545 SECTION 4. (a) The legal notice of the intention to
4646 introduce this Act, setting forth the general substance of this
4747 Act, has been published as provided by law, and the notice and a
4848 copy of this Act have been furnished to all persons, agencies,
4949 officials, or entities to which they are required to be furnished
5050 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
5151 Government Code.
5252 (b) The governor, one of the required recipients, has
5353 submitted the notice and Act to the Texas Commission on
5454 Environmental Quality.
5555 (c) The Texas Commission on Environmental Quality has filed
5656 its recommendations relating to this Act with the governor, the
5757 lieutenant governor, and the speaker of the house of
5858 representatives within the required time.
5959 (d) All requirements of the constitution and laws of this
6060 state and the rules and procedures of the legislature with respect
6161 to the notice, introduction, and passage of this Act are fulfilled
6262 and accomplished.
6363 SECTION 5. This Act takes effect immediately if it receives
6464 a vote of two-thirds of all the members elected to each house, as
6565 provided by Section 39, Article III, Texas Constitution. If this
6666 Act does not receive the vote necessary for immediate effect, this
6767 Act takes effect September 1, 2017.
