6	6	AN ACT
7	7	relating to the territory of the Barton Springs-Edwards Aquifer
8	8	Conservation District.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 8802.003, Special District Local Laws
11	11	Code, is amended to read as follows:
12	12	Sec. 8802.003. DISTRICT TERRITORY. (a) The district is
13	13	composed of:
14	14	(1) the territory described by the Texas Water
15	15	Commission's August 15, 1986, order, as that territory may have
16	16	been modified under:
17	17	(A) [(1)] Subchapter J, Chapter 36, Water Code;
18	18	or
19	19	(B) [(2)] other law; and
20	20	(2) the territory described as follows:
21	21	Beginning at a point at the intersection of the district
22	22	boundary as it existed on January 1, 2017, and IH-35 and East
23	23	William Cannon Drive, then running east on East William Cannon
24	24	Drive to a point where East William Cannon Drive intersects Bluff
25	25	Springs Road, then south and southeasterly along Bluff Springs Road
26	26	to a point where Bluff Springs Road intersects the district
27	27	boundary as it existed on January 1, 2017, then west and
28	28	southwesterly turning northeasterly along the district boundary as
29	29	it existed on January 1, 2017, to the place of beginning.
30	30	(b) A boundary reference in Subsection (a) to a road,
31	31	highway, or drive means the centerline, as of January 1, 2017, of
32	32	the road, highway, or drive.
33	33	SECTION 2. Section 8802.053, Special District Local Laws
34	34	Code, is amended by adding Subsection (f) to read as follows:
35	35	(f) If the district is required to create single-member
36	36	districts that do not comply with other provisions of this section
37	37	in order to satisfy standards under federal law, the board of
38	38	directors shall revise the single-member districts as the board
39	39	considers appropriate to comply with those federal standards.
40	40	SECTION 3. The board of directors of the Barton
41	41	Springs-Edwards Aquifer Conservation District shall add the
42	42	territory described by Section 8802.003(a)(2), Special District
43	43	Local Laws Code, as added by this Act, to single-member district
44	44	number four, as that district existed on May 26, 2016.
45	45	SECTION 4. (a) The legal notice of the intention to
46	46	introduce this Act, setting forth the general substance of this
47	47	Act, has been published as provided by law, and the notice and a
48	48	copy of this Act have been furnished to all persons, agencies,
49	49	officials, or entities to which they are required to be furnished
50	50	under Section 59, Article XVI, Texas Constitution, and Chapter 313,
51	51	Government Code.
52	52	(b) The governor, one of the required recipients, has
53	53	submitted the notice and Act to the Texas Commission on
54	54	Environmental Quality.
55	55	(c) The Texas Commission on Environmental Quality has filed
56	56	its recommendations relating to this Act with the governor, the
57	57	lieutenant governor, and the speaker of the house of
58	58	representatives within the required time.
59	59	(d) All requirements of the constitution and laws of this
60	60	state and the rules and procedures of the legislature with respect
61	61	to the notice, introduction, and passage of this Act are fulfilled
62	62	and accomplished.
63	63	SECTION 5. This Act takes effect immediately if it receives
64	64	a vote of two-thirds of all the members elected to each house, as
65	65	provided by Section 39, Article III, Texas Constitution. If this
66	66	Act does not receive the vote necessary for immediate effect, this
67	67	Act takes effect September 1, 2017.
