13 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

14 | 8 | | SECTION 1. Section 1954.001(4), Insurance Code, is amended |
---|
15 | 9 | | to read as follows: |
---|
16 | 10 | | (4) "Transportation network company" means a |
---|
17 | 11 | | corporation, partnership, sole proprietorship, or other entity |
---|
18 | 12 | | operating in this state that uses a digital network to connect a |
---|
19 | 13 | | transportation network company rider to a transportation network |
---|
20 | 14 | | company driver for a prearranged ride. [The term does not include |
---|
21 | 15 | | an entity arranging nonemergency medical transportation under a |
---|
22 | 16 | | contract with the state or a managed care organization for |
---|
23 | 17 | | individuals qualifying for Medicaid or Medicare.] |
---|
24 | 18 | | SECTION 2. Section 1954.002, Insurance Code, is amended to |
---|
25 | 19 | | read as follows: |
---|
26 | 20 | | Sec. 1954.002. APPLICABILITY OF CHAPTER. (a) This chapter |
---|
27 | 21 | | applies to automobile insurance policies in this state, including |
---|
28 | 22 | | policies issued by a Lloyd's plan, a reciprocal or interinsurance |
---|
29 | 23 | | exchange, and a county mutual insurance company. |
---|
30 | 24 | | (b) This chapter does not apply to an entity arranging |
---|
31 | 25 | | nonemergency medical transportation services under a contract with |
---|
32 | 26 | | the state or a managed care organization for individuals qualifying |
---|
33 | 27 | | for Medicaid or Medicare unless the entity: |
---|
34 | 28 | | (1) provides the transportation services through a |
---|
35 | 29 | | digital network that connects transportation network company |
---|
36 | 30 | | drivers to transportation network company riders for prearranged |
---|
37 | 31 | | rides; |
---|
38 | 32 | | (2) contracts individually with each transportation |
---|
39 | 33 | | network company driver who is connected to transportation network |
---|
40 | 34 | | company riders for the prearranged rides through the entity's |
---|
41 | 35 | | digital network; and |
---|
42 | 36 | | (3) otherwise meets all requirements under the |
---|
43 | 37 | | Medicaid or Medicare program for delivery of nonemergency medical |
---|
44 | 38 | | transportation services. |

45 | 39 | | SECTION 3. This Act takes effect September 1, 2017. |
