115 relating to the term for a lease of land owned by certain navigation
126 districts.
137 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
148 SECTION 1. Section 60.039, Water Code, is amended by
159 amending Subsection (a) and adding Subsection (c) to read as
1610 follows:
1711 (a) Except as provided by Subsection (c), the [The]
1812 commission may lease the surface of land for not more than 50 years
1913 by the entry of an order on the minutes of the commission and the
2014 execution of a lease in the manner provided by the original order.
2115 The lease may not be extended beyond the 50-year period by renewal,
2216 extension, or otherwise.
2317 (c) This subsection applies only to a district that operates
2418 a port in this state that is wholly located in a county that borders
2519 the Gulf of Mexico and that is adjacent to a county that contains an
2620 international border and borders the Gulf of Mexico. The district
2721 may lease the surface of land for not more than 99 years or may
2822 extend a lease to a period not to exceed 99 years only if:
2923 (1) the lease conveys an interest in the surface of the
3024 land for residential purposes only;
3125 (2) at the time the lease will be entered into or
3226 extended, the district has not less than 50 leases in effect that
3327 convey an interest in the land surface for residential purposes
3428 only; and
3529 (3) any part of the land owned by the district is
3630 subdivided into lots intended for residential use.
3731 SECTION 2. This Act takes effect September 1, 2017.
