88 AN ACT
99 relating to notice and continuing education requirements regarding
1010 human trafficking for cosmetologists and cosmetology facilities.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 1602.354, Occupations Code, is amended
1313 by adding Subsection (c) to read as follows:
1414 (c) The commission shall require continuing education
1515 programs under this chapter to include information on:
1616 (1) activities commonly associated with human
1717 trafficking;
1818 (2) recognition of potential victims of human
1919 trafficking; and
2020 (3) methods for assisting victims of human
2121 trafficking, including how to report human trafficking.
2222 SECTION 2. Subchapter I, Chapter 1602, Occupations Code, is
2323 amended by adding Section 1602.408 to read as follows:
2424 Sec. 1602.408. POSTING OF CERTAIN NOTICES REQUIRED. (a) In
2525 this section, "licensed facility" means the premises of a place of
2626 business that holds a license, certificate, or permit under this
2727 chapter.
2828 (b) A licensed facility shall display a sign approved by or
2929 acceptable to the commission or the department concerning services
3030 and assistance available to victims of human trafficking.
3131 (c) The sign required by this section must be in English,
3232 Spanish, and Vietnamese and include a toll-free telephone number of
3333 a nationally recognized information and referral hotline for
3434 victims of human trafficking.
3535 (d) The commission by rule shall establish requirements
3636 regarding the posting of signs under this section.
3737 SECTION 3. (a) Not later than March 1, 2018, the Texas
3838 Commission of Licensing and Regulation shall adopt rules as
3939 necessary to comply with Section 1602.354, Occupations Code, as
4040 amended by this Act.
4141 (b) Section 1602.354(c), Occupations Code, as added by this
4242 Act, and the rules adopted under Subsection (a) of this section
4343 apply only to a continuing education program provided on or after
4444 September 1, 2018.
4545 SECTION 4. (a) Not later than January 1, 2018, the Texas
4646 Commission of Licensing and Regulation shall adopt rules as
4747 necessary to implement Section 1602.408, Occupations Code, as added
4848 by this Act.
4949 (b) A licensed facility as defined by Section 1602.408(a),
5050 Occupations Code, as added by this Act, shall comply with Section
5151 1602.408, Occupations Code, as added by this Act, not later than
5252 February 1, 2018.
5353 SECTION 5. This Act takes effect September 1, 2017.
