| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 2165, Government Code, is amended by |
|---|
| 11 | 11 | | adding Subchapter A-1 to read as follows: |
|---|
| 12 | 12 | | SUBCHAPTER A-1. CIGARETTE, E-CIGARETTE, OR TOBACCO PRODUCT USE ON |
|---|
| 13 | 13 | | STATE PROPERTY |
|---|
| 14 | 14 | | Sec. 2165.031. APPLICABILITY. Notwithstanding Section |
|---|
| 15 | 15 | | 2165.002, this subchapter applies to any property owned by this |
|---|
| 16 | 16 | | state and used by a state agency, including an institution of higher |
|---|
| 17 | 17 | | education as defined by Section 61.003, Education Code. |
|---|
| 18 | 18 | | Sec. 2165.032. DEFINITIONS. In this subchapter: |
|---|
| 19 | 19 | | (1) "Cigarette" has the meaning assigned by Section |
|---|
| 20 | 20 | | 154.001, Tax Code. |
|---|
| 21 | 21 | | (2) "E-cigarette" has the meaning assigned by Section |
|---|
| 22 | 22 | | 161.081, Health and Safety Code. |
|---|
| 23 | 23 | | (3) "Tobacco product" has the meaning assigned by |
|---|
| 24 | 24 | | Section 155.001, Tax Code. |
|---|
| 25 | 25 | | Sec. 2165.033. PROHIBITION OF CIGARETTE, E-CIGARETTE, OR |
|---|
| 26 | 26 | | TOBACCO PRODUCT USE ON STATE PROPERTY. The use of a cigarette, |
|---|
| 27 | 27 | | e-cigarette, or tobacco product is prohibited in any building or on |
|---|
| 28 | 28 | | any grounds owned by this state and used by a state agency. |
|---|
| 29 | 29 | | SECTION 2. Chapter 2167, Government Code, is amended by |
|---|
| 30 | 30 | | adding Subchapter A-1 to read as follows: |
