85R3409 AJZ-D By: Miller H.B. No. 2652 A BILL TO BE ENTITLED AN ACT relating to the use of cigarettes, e-cigarettes, or tobacco products on property owned by or leased for a state agency. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Chapter 2165, Government Code, is amended by adding Subchapter A-1 to read as follows: SUBCHAPTER A-1. CIGARETTE, E-CIGARETTE, OR TOBACCO PRODUCT USE ON STATE PROPERTY Sec. 2165.031. APPLICABILITY. Notwithstanding Section 2165.002, this subchapter applies to any property owned by this state and used by a state agency, including an institution of higher education as defined by Section 61.003, Education Code. Sec. 2165.032. DEFINITIONS. In this subchapter: (1) "Cigarette" has the meaning assigned by Section 154.001, Tax Code. (2) "E-cigarette" has the meaning assigned by Section 161.081, Health and Safety Code. (3) "Tobacco product" has the meaning assigned by Section 155.001, Tax Code. Sec. 2165.033. PROHIBITION OF CIGARETTE, E-CIGARETTE, OR TOBACCO PRODUCT USE ON STATE PROPERTY. The use of a cigarette, e-cigarette, or tobacco product is prohibited in any building or on any grounds owned by this state and used by a state agency. SECTION 2. Chapter 2167, Government Code, is amended by adding Subchapter A-1 to read as follows: SUBCHAPTER A-1. CIGARETTE, E-CIGARETTE, OR TOBACCO PRODUCT USE IN SPACE LEASED BY STATE AGENCY Sec. 2167.031. APPLICABILITY. Notwithstanding Section 2167.001, this subchapter applies to any space used by a state agency, including an institution of higher education as defined by Section 61.003, Education Code. Sec. 2167.032. DEFINITIONS. In this subchapter: (1) "Cigarette" has the meaning assigned by Section 154.001, Tax Code. (2) "E-cigarette" has the meaning assigned by Section 161.081, Health and Safety Code. (3) "Tobacco product" has the meaning assigned by Section 155.001, Tax Code. Sec. 2167.033. PROHIBITION ON USE OF CIGARETTES, E-CIGARETTES, AND TOBACCO PRODUCTS IN SPACE LEASED BY STATE AGENCY. The use of a cigarette, e-cigarette, or tobacco product is prohibited in any space leased by this state for the use of a state agency. SECTION 3. This Act takes effect September 1, 2017.
