7 | 7 | | relating to remedies in certain taxpayer suits against the state. |

8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Subchapter A, Chapter 112, Tax Code, is amended |
---|
10 | 10 | | by adding Section 112.003 to read as follows: |

11 | 11 | | Sec. 112.003. ATTORNEY'S FEES. Notwithstanding any other |
---|
12 | 12 | | law, a court may not award attorney's fees in a suit against the |
---|
13 | 13 | | state, a state agency, or a state officer or employee that seeks |
---|
14 | 14 | | legal or equitable relief relating to the applicability, |
---|
15 | 15 | | assessment, collection, constitutionality, or amount of a tax or |
---|
16 | 16 | | fee imposed under this title or collected by the comptroller under |
---|
17 | 17 | | any law, including a local tax collected by the comptroller. |
---|
18 | 18 | | SECTION 2. Section 112.108, Tax Code, is repealed. |
---|
19 | 19 | | SECTION 3. The changes in law made by this Act apply only to |
---|
20 | 20 | | an action that is commenced on or after the effective date of this |
---|
21 | 21 | | Act. An action commenced before the effective date of this Act is |
---|
22 | 22 | | governed by the law in effect on the date the action was commenced, |
---|
23 | 23 | | and the former law is continued in effect for that purpose. |
---|
24 | 24 | | SECTION 4. This Act takes effect September 1, 2017. |
