| 8 | 8 | | school student who assaults a sports official or other competition |
|---|
| 9 | 9 | | judge during an extracurricular competition. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter D, Chapter 33, Education Code, is |
|---|
| 12 | 12 | | amended by adding Section 33.090 to read as follows: |
|---|
| 13 | 13 | | Sec. 33.090. CERTAIN STUDENTS BANNED FROM COMPETITION. (a) |
|---|
| 14 | 14 | | In this section: |
|---|
| 15 | 15 | | (1) "Assault" means conduct that contains the elements |
|---|
| 16 | 16 | | of the offense of assault under Section 22.01(a)(1) or (3), Penal |
|---|
| 17 | 17 | | Code. |
|---|
| 18 | 18 | | (2) "Association" means the Texas Association of |
|---|
| 19 | 19 | | Private and Parochial Schools or a successor organization. |
|---|
| 20 | 20 | | (3) "League" means the University Interscholastic |
|---|
| 21 | 21 | | League. |
|---|
| 22 | 22 | | (b) A public or private school student who assaults a sports |
|---|
| 23 | 23 | | official or other competition judge during a competition sponsored |
|---|
| 24 | 24 | | or sanctioned by the league or association is prohibited from |
|---|
| 25 | 25 | | participating in any subsequent competition sponsored or |
|---|
| 26 | 26 | | sanctioned by the league or association. |
|---|
| 27 | 27 | | (c) The league or association may suspend the student's |
|---|
| 28 | 28 | | eligibility to participate immediately on the occurrence of an |
|---|
| 29 | 29 | | alleged assault during a competition. Subsequent league or |
|---|
| 30 | 30 | | association action implementing the prohibition of the student from |
|---|
| 31 | 31 | | competition under this section must occur in accordance with |
|---|
| 32 | 32 | | league or association rules or procedures applicable to the |
|---|
| 33 | 33 | | student's conduct, provided that the rules and procedures are |
|---|
| 34 | 34 | | consistent with the requirements of this section. |
|---|
| 35 | 35 | | (d) The prohibition of a student from competition under this |
|---|
| 36 | 36 | | section: |
|---|
| 37 | 37 | | (1) remains in effect until the student graduates from |
|---|
| 38 | 38 | | high school; and |
|---|
| 39 | 39 | | (2) shall be enforced jointly by the league and |
|---|
| 40 | 40 | | association, regardless of whether the assault occurred during a |
|---|
| 41 | 41 | | competition sponsored or sanctioned by the league or the |
|---|
| 42 | 42 | | association. |
|---|
| 43 | 43 | | (e) For purposes of Subsection (d)(2), the league and |
|---|
| 44 | 44 | | association shall share information regarding each student |
|---|
| 45 | 45 | | prohibited from competition under this section on the basis of an |
|---|
| 46 | 46 | | assault. |
|---|
| 47 | 47 | | SECTION 2. Section 33.090, Education Code, as added by this |
|---|
| 48 | 48 | | Act, applies only to conduct that occurs on or after the effective |
|---|
| 49 | 49 | | date of this Act. |
|---|
| 50 | 50 | | SECTION 3. This Act takes effect September 1, 2017. |
