66 AN ACT
77 relating to a ban from subsequent competition of a public or private
88 school student who assaults a sports official or other competition
99 judge during an extracurricular competition.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter D, Chapter 33, Education Code, is
1212 amended by adding Section 33.090 to read as follows:
1313 Sec. 33.090. CERTAIN STUDENTS BANNED FROM COMPETITION. (a)
1414 In this section:
1515 (1) "Assault" means conduct that contains the elements
1616 of the offense of assault under Section 22.01(a)(1) or (3), Penal
1717 Code.
1818 (2) "Association" means the Texas Association of
1919 Private and Parochial Schools or a successor organization.
2020 (3) "League" means the University Interscholastic
2121 League.
2222 (b) A public or private school student who assaults a sports
2323 official or other competition judge during a competition sponsored
2424 or sanctioned by the league or association is prohibited from
2525 participating in any subsequent competition sponsored or
2626 sanctioned by the league or association.
2727 (c) The league or association may suspend the student's
2828 eligibility to participate immediately on the occurrence of an
2929 alleged assault during a competition. Subsequent league or
3030 association action implementing the prohibition of the student from
3131 competition under this section must occur in accordance with
3232 league or association rules or procedures applicable to the
3333 student's conduct, provided that the rules and procedures are
3434 consistent with the requirements of this section.
3535 (d) The prohibition of a student from competition under this
3636 section:
3737 (1) remains in effect until the student graduates from
3838 high school; and
3939 (2) shall be enforced jointly by the league and
4040 association, regardless of whether the assault occurred during a
4141 competition sponsored or sanctioned by the league or the
4242 association.
4343 (e) For purposes of Subsection (d)(2), the league and
4444 association shall share information regarding each student
4545 prohibited from competition under this section on the basis of an
4646 assault.
4747 SECTION 2. Section 33.090, Education Code, as added by this
4848 Act, applies only to conduct that occurs on or after the effective
4949 date of this Act.
5050 SECTION 3. This Act takes effect September 1, 2017.
