 A BILL TO BE ENTITLED
 AN ACT
 relating to a ban from subsequent competition of a public or private
 school student who assaults a sports official or other competition
 judge during an extracurricular competition.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Subchapter D, Chapter 33, Education Code, is
 amended by adding Section 33.090 to read as follows:
 Sec. 33.090.  CERTAIN STUDENTS BANNED FROM COMPETITION. (a)
 In this section:
 (1)  "Assault" means conduct that contains the elements
 of the offense of assault under Section 22.01(a)(1) or (3), Penal
 Code.
 (2)  "Association" means the Texas Association of
 Private and Parochial Schools or a successor organization.
 (3)  "League" means the University Interscholastic
 League.
 (b)  A public or private school student who assaults a sports
 official or other competition judge during a competition sponsored
 or sanctioned by the league or association is prohibited from
 participating in any subsequent competition sponsored or
 sanctioned by the league or association.
 (c)  The league or association may suspend the student's
 eligibility to participate immediately on the occurrence of an
 alleged assault during a competition.  Subsequent league or
 association action implementing the prohibition of the student from
 competition under this section must occur in accordance with
 league or association rules or procedures applicable to the
 student's conduct, provided that the rules and procedures are
 consistent with the requirements of this section.
 (d)  The prohibition of a student from competition under this
 section:
 (1)  remains in effect until the student graduates from
 high school; and
 (2)  shall be enforced jointly by the league and
 association, regardless of whether the assault occurred during a
 competition sponsored or sanctioned by the league or the
 association.
 (e)  For purposes of Subsection (d)(2), the league and
 association shall share information regarding each student
 prohibited from competition under this section on the basis of an
 assault.
 SECTION 2.  Section 33.090, Education Code, as added by this
 Act, applies only to conduct that occurs on or after the effective
 date of this Act.
 SECTION 3.  This Act takes effect September 1, 2017.
